Sexually motivated assault

AN ACT Relating to criminal classification and penalties for 1
sexually motivated assault in the fourth degree with a prior history 2
of certain sex offenses or other sexually motivated crimes; amending 3
RCW 9A.36.041 and 9.94A.515; and prescribing penalties.4
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:5
Sec. 1. RCW 9A.36.041 and 2021 c 215 s 106 are each amended to 6
read as follows: 7
(1) A person is guilty of assault in the fourth degree if, under 8
circumstances not amounting to assault in the first, second, or third 9
degree, or custodial assault, he or she assaults another.10
(2) Assault in the fourth degree is a gross misdemeanor, except 11
as provided in ((subsection)) subsections (3) and (4) of this 12
section. 13
(3)(a) Assault in the fourth degree occurring after July 23, 14
2017, and before March 18, 2020, where domestic violence is pleaded 15
and proven, is a class C felony if the person has two or more prior 16
adult convictions within ten years for any of the following offenses 17
occurring after July 23, 2017, where domestic violence was pleaded 18
and proven: 19
(i) Repetitive domestic violence offense as defined in RCW 20
9.94A.030; 21

For purposes of this subsection (3)(a), "family or household 8
members" for purposes of the definition of "domestic violence" means 9
spouses, domestic partners, former spouses, former domestic partners, 10
persons who have a child in common regardless of whether they have 11
been married or have lived together at any time, persons ((sixteen)) 12
16 years of age or older who are presently residing together or who 13
have resided together in the past and who have or have had a dating 14
relationship, and persons ((sixteen)) 16 years of age or older with 15
whom a person ((sixteen)) 16 years of age or older has or has had a 16
dating relationship. "Family or household member" also includes an 17
"intimate partner" as defined in RCW 10.99.020. 18
(b) Assault in the fourth degree occurring on or after March 18, 19
2020, where domestic violence against an "intimate partner" as 20
defined in RCW 10.99.020 is pleaded and proven, is a class C felony 21
if the person has two or more prior adult convictions within ten 22
years for any of the following offenses occurring after July 23, 23
2017, where domestic violence against an "intimate partner" as 24
defined in RCW 10.99.020 or domestic violence against a "family or 25
household member" as defined in (a) of this subsection was pleaded 26
and proven: 27
(i) Repetitive domestic violence offense as defined in RCW 28
9.94A.030; 29
(ii) Crime of harassment as defined by RCW 9A.46.060;30
(iii) Assault in the third degree; 31
(iv) Assault in the second degree; 32
(v) Assault in the first degree; or 33
(vi) A municipal, tribal, federal, or out-of-state offense 34
comparable to any offense under (b)(i) through (v) of this 35
subsection. 36
(4) Assault in the fourth degree occurring on or after the 37
effective date of this section, with a finding of sexual motivation 38
under RCW 9.94A.835, is a class C felony if the person has two or 39

more prior adult convictions within 10 years for any of the following 1
offenses occurring on or after the effective date of this section:2
(a) Any sex offense as defined in RCW 9A.44.128;3
(b) Assault in the fourth degree, with a finding of sexual 4
motivation under RCW 9.94A.835; or5
(c) Any municipal, tribal, federal, or out-of-state offense which 6
is comparable to the offense described under (b) of this subsection.7
