  • A new section is added to chapter 71A.20 3 RCW to read as follows: 4 (1) Any time the department receives notice that a residential 5 habilitation center is out of compliance with the centers for 6 medicare and medicaid services conditions of participation or 7 requirements, the secretary or the secretary's designee shall provide 8 notice, in the manner described in subsection (2) of this section, 9 within 10 days, of the following: 10 (a) The initial statement of deficiencies or other determination 11 of noncompliance, including the reason or reasons for the finding of 12 noncompliance, and a plain language summary of the findings that 13 explains the nature of the noncompliance and its potential impact on 14 resident safety; 15 (b) Establishment of any plan of correction for the facility; and16 (c) All subsequent determinations regarding the facility's 17 return, or failure to return, to compliance, and any related 18 enforcement action.

AN ACT Relating to increasing transparency regarding residential 1
habilitation center compliance with certain federal requirements; and 2
adding a new section to chapter 71A.20 RCW. 3
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:4
NEW SECTION. Sec. 1. A new section is added to chapter 71A.20 5
RCW to read as follows: 6
Any time the department receives notice that a residential 7
habilitation center is out of compliance with the centers for 8
medicare and medicaid services conditions of participation, the 9
secretary shall provide written notice within 10 days to each 10
resident of the residential habilitation center and additional 11
individuals as indicated in RCW 71A.10.060 of each of the following:12
(1) The initial statement of deficiencies or other determination 13
of noncompliance, including the reason or reasons for the finding of 14
noncompliance; 15
(2) Establishment of any plan of correction for the facility; and16
(3) All subsequent determinations regarding the facility's 17
return, or failure to return, to compliance, and any related federal 18
enforcement action. 19
