AN ACT Relating to assessment and support requirements for 1
housing; adding a new section to chapter 43.330 RCW; and creating a 2
new section. 3
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:4
NEW SECTION. Sec. 1. The legislature finds that the state can 5
support individuals experiencing homelessness by requiring 6
participation in substance use treatment, when assessed as a need, as 7
a condition of receiving housing services, promoting recovery and 8
long-term stability. The legislature further finds that standardized 9
reporting and monitoring can ensure prioritization of results-10
oriented decision making in funding housing programs. Therefore, the 11
legislature intends to establish clear expectations for substance use 12
treatment and ensure individuals in transitional or permanent 13
supportive housing receive the care they need, while maintaining 14
accountability and not tacitly approving ongoing substance use. The 15
legislature further intends to strengthen accountability and 16
oversight of state-funded housing programs and ensure accurate, 17
reliable data is provided on effectiveness and outcomes.18

(1) The department must require grantees and subgrantees that 1
receive funding for transitional or permanent supportive housing to 2
require: 3
(a) All individuals housed to be assessed for a substance use 4
disorder; and 5
(b) Any individual assessed with a substance use disorder to 6
comply with all substance use treatment recommendations and abstain 7
from alcohol and unprescribed drugs as a condition of remaining 8
eligible for housing. 9
(2) Grant recipients for transitional or permanent supportive 10
housing must enter and track each program participant through the 11
Washington homeless client management information system as described 12
in RCW 43.185C.180, including: 13
(a) The date the participant was assessed for a substance use 14
disorder; 15
(b) Whether the participant was determined to have a substance 16
use disorder; 17
(c) What services are being provided to the participant;18
(d) Whether the participant is actively participating in 19
substance use disorder treatment; and 20
(e) Whether the participant was discharged from housing due to 21
noncompliance with substance use disorder treatment or conditions.22
(3) By December 1, 2026, and by each following December 1st, the 23
department must require grantees that receive funding for 24
transitional or permanent supportive housing to submit a report 25
summarizing: 26
(a) The number of participants served; 27
(b) The number of participants assessed as having a substance use 28
disorder; and 29
(c) The length of time each participant has complied with 30
substance use disorder treatment and conditions. 31
