AN ACT Relating to reporting requirements and law enforcement 1
responses for incidents at private detention facilities; amending RCW 2
70.395.060; and adding a new section to chapter 70.395 RCW.3
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:4
Sec. 1. RCW 70.395.060 and 2025 c 235 s 6 are each amended to 5
read as follows: 6
(1) This section does not apply to private detention facilities 7
operating pursuant to a valid contract that was in effect prior to 8
January 1, 2023, for the duration of that contract, not to include 9
any extensions or modifications made to, or authorized by, that 10
contract. 11
(2) A private detention facility operating pursuant to a contract 12
or agreement with a federal, state, or local government shall comply 13
with the following: 14
(a) The private detention facility shall: 15
(i) Comply with food service rules under chapters 246-215 and 16
246-217 WAC; 17
(ii) Designate an individual responsible for managing and 18
supervising food services 24 hours per day, including:19
(A) Incorporating ongoing recommendations of a dietitian;20

(B) Serving at least three meals a day at regular intervals with 1
15 or fewer hours between the evening meal and breakfast, unless the 2
facility provides a nutritious snack between the evening meal and 3
breakfast; 4
(C) Providing well-balanced meals and nourishments that meet the 5
current recommendations published in recommended dietary allowances 6
by the national research council, 10th edition, 1989, adjusted for 7
the detained person's age, sex, and activities unless 8
contraindicated; 9
(D) Making nourishing snacks available as needed for detained 10
persons, and posted as part of the menu; 11
(E) Preparing and serving therapeutic diets according to written 12
medical orders; 13
(F) Preparing and serving meals under the supervision of food 14
service staff; 15
(G) Maintaining a current diet manual, approved in writing by the 16
dietitian and medical staff, for use in planning and preparing 17
therapeutic diets; and 18
(H) Ensuring all menus: Are written at least one week in advance; 19
indicate the date, day of week, month, and year; include all foods 20
and snacks served that contribute to nutritional requirements; 21
provide a variety of foods; are approved in writing by the dietitian; 22
are posted in a location easily accessible to detained persons at the 23
facility; and are retained for one year; 24
(iii) Substitute foods, when necessary, of comparable nutrient 25
value and record changes on the menu; 26
(iv) Allow sufficient time for detained persons to consume meals;27
(v) Ensure staff from dietary and food services are present in 28
the facility during all meal times; and 29
(vi) Keep policies and procedures pertaining to food storage, 30
preparation, and cleaning food service equipment and work areas in 31
the food service area for easy reference by dietary staff at all 32
times; 33
(b) The private detention facility shall provide a readily 34
available telephone for detained persons to make and receive 35
confidential calls, and make a nonpay telephone or equivalent 36
communication device readily accessible on each floor occupied by a 37
detained person for emergency use; 38
(c) The private detention facility shall provide a visiting area 39
allowing privacy for detained persons and visitors;40

(d) The private detention facility shall report to the department 1
of health and the law enforcement agency with primary jurisdiction in 2
the area the facility is located, by the end of the next business day 3
of the incident occurring, serious or undesirable outcomes that occur 4
in the facility, including:5
(i) Allegations of abuse or neglect;6
(ii) Death;7
(iii) Suicide;8
(iv) Injuries resulting in an inpatient hospital stay; and9
(v) Disruption of services through internal or external emergency 10
or disaster;11
(e) The private detention facility shall develop and implement 12
the written policies and procedures consistent with assuring the 13
rights of detained persons, protecting against abuse and neglect, and 14
reporting suspected incidents, and post those policies and procedures 15
in a prominent place for detained persons at the facility to read;16
(((e))) (f) The private detention facility shall employ 17
sufficient, qualified staff to: 18
(i) Provide adequate services to detained persons;19
(ii) Maintain the facility free of safety hazards; and20
(iii) Implement fire and disaster plans; 21
(((f))) (g) The private detention facility shall provide and 22
document orientation and appropriate training for all staff, 23
including: 24
(i) Organization of the facility; 25
(ii) Physical layout of facility, including buildings, 26
departments, exits, and services; 27
(iii) Fire and disaster plans, including monthly drills;28
(iv) Infection control; 29
(v) Specific duties and responsibilities; 30
(vi) Policies, procedures, and equipment necessary to perform 31
duties; 32
(vii) Policies related to the rights of detained persons and 33
protecting against abuse and neglect; 34
(viii) Managing the behavior of detained persons; and35
(ix) Appropriate training for expected duties; and36
(((g))) (h) The private detention facility shall establish and 37
implement an effective facility-wide infection control program 38
including, at a minimum, the following: 39
(i) Written policies and procedures describing:40

(A) Types of surveillance used to monitor rates of infections 1
originating at the facility; 2
(B) Systems to collect and analyze data; and 3
(C) Activities to prevent and control infections;4
(ii) A review process to determine if staff and detained person 5
infections originated at the facility; 6
(iii) A procedure for reviewing and approving infection control 7
aspects of policies and procedures used in each area of the facility;8
(iv) A procedure to monitor the physical environment of the 9
facility for situations which may contribute to the spread of 10
infectious diseases; and 11
(v) Provisions for: 12
(A) Providing consultation regarding care practices, equipment, 13
and supplies which may influence the risk of infection;14
(B) Providing consultation regarding appropriate procedures and 15
products for cleaning, disinfecting, and sterilizing;16
(C) Providing infection control information for orientation and 17
in-service education for staff providing direct care;18
(D) Making recommendations, consistent with federal, state, and 19
local laws and rules, for methods of safe and sanitary disposal of 20
sewage, solid and liquid wastes, and infectious wastes, including 21
safe management of sharps; 22
(E) Identifying specific precautions to prevent transmission of 23
infections; and 24
(F) Coordinating employee activities to control exposure and 25
transmission of infections to or from employees and others performing 26
services. 27
(3) The office of the attorney general may enforce violations of 28
this section on its own initiative or in response to complaints or 29
violations. 30
NEW SECTION. Sec. 2. A new section is added to chapter 70.395 31
RCW to read as follows: 32
Beginning November 1, 2026, and every year thereafter, each law 33
enforcement agency in the state having one or more private detention 34
facilities in its jurisdiction shall submit an annual report to the 35
department of health containing the following information for each 36
facility in its jurisdiction: 37
(1) The number of calls that were received related to incidents 38
at or involving the facility; and 39

(2) For each such call: 1
(a) Whether the agency responded to the call or conducted any 2
further investigation; 3
(b) Whether law enforcement spoke with the victim;4
(c) Whether the victim was provided a copy of the police report 5
for the incident; 6
(d) Whether the agency received an internal report or other 7
information from the facility related to the incident;8
(e) Whether the agency referred the case for prosecution; and9
(f) Whether a prosecution resulted. 10
