AN ACT Relating to ensuring that work on fire protection 1
sprinkler systems is performed by licensed contractors and certified 2
fitters; amending RCW 18.270.070; adding new sections to chapter 3
18.160 RCW; and prescribing penalties. 4
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:5
NEW SECTION. Sec. 1. A new section is added to chapter 18.160 6
RCW to read as follows: 7
(1) The state director of fire protection or their authorized 8
representative must investigate alleged violations of this chapter.9
(2) Upon the request of a fire code official, a fire protection 10
sprinkler system contractor performing work on a fire protection 11
sprinkler system must produce evidence of a license issued by the 12
director of fire protection under this chapter. Failure to produce 13
such evidence is an infraction under this chapter.14
(3) If the fire protection sprinkler system contractor working on 15
a fire protection sprinkler system does not have a license or is 16
otherwise acting in violation of this chapter, the fire code official 17
may issue a stop work order on the project. The order remains in 18
effect until the fire code official or state director of fire 19
protection finds that the contractor is in compliance with this 20

chapter or otherwise finds that the work will be conducted in 1
compliance with this chapter. 2
(4) A fire code official may determine whether public safety 3
warrants the removal and replacement of a fire protection sprinkler 4
system or any component thereto that has been installed, altered, or 5
extended by an unlicensed fire protection sprinkler system 6
contractor. 7
(5) If a fire code official finds that a fire protection 8
sprinkler system contractor working on a fire protection sprinkler 9
system does not have a license or is in violation of other provisions 10
of this chapter, the fire official shall promptly notify the state 11
director of fire protection or their designee to initiate an 12
investigation. 13
(6) For purposes of this section, "fire code official" means any 14
person authorized by a city, town, county, or local governing body 15
with jurisdiction over fire industry regulation or any other person 16
authorized by the state director of fire protection to conduct 17
enforcement under this chapter. 18
NEW SECTION. Sec. 2. A new section is added to chapter 18.160 19
RCW to read as follows: 20
The state director of fire protection or the director's designee, 21
may require a fire protection sprinkler system contractor to provide 22
all relevant payroll records in a timely manner pertaining to an 23
active investigation under this chapter. 24
Sec. 3. RCW 18.270.070 and 2023 c 329 s 6 are each amended to 25
read as follows: 26
(1) An authorized representative of the director must investigate 27
alleged violations of this chapter. 28
(2) Upon the request of ((an authorized representative )) a fire 29
code official, a person performing fire protection sprinkler fitting 30
or residential sprinkler fitting work must produce evidence of a 31
certificate issued by the director in accordance with this chapter. 32
Failure to produce such evidence is an infraction as provided by RCW 33
18.270.020. 34
(3) If a person performing fire protection sprinkler fitting or 35
residential sprinkler fitting work does not have a certificate or if 36
a person or contractor is otherwise acting in violation of this 37
chapter, the fire code official may issue a stop work order on the 38

project. The order remains in effect until the fire code official or 1
director finds that the person or contractor is in compliance or 2
otherwise finds that the work will be conducted in compliance with 3
this chapter. 4
(4) A fire code official may determine whether public safety 5

system or any component thereto that has been installed, altered, or 7
extended by an uncertified person.8
(5) If a fire code official finds that a person working on a fire 9
protection sprinkler system does not have a certificate or finds that 10
a person or contractor is otherwise violating the requirements in 11
this chapter, the fire official shall promptly notify the director or 12
the director's designee to initiate an investigation.13
(6) For purposes of this section, "fire code official" means any 14
person authorized by a city, town, county, or local governing body 15
with jurisdiction over fire industry regulation or any other person 16
authorized by the state director of fire protection to conduct 17
enforcement under this chapter.18
