AN ACT Relating to enforcement of plumbing contractor 1
requirements; and amending RCW 18.106.270. 2
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:3
Sec. 1. RCW 18.106.270 and 2020 c 153 s 19 are each amended to 4
read as follows: 5
(1) A person found to have committed an infraction under RCW 6
18.106.020 shall be assessed a minimum monetary penalty of ((one 7
hundred dollars )) $100 for the first infraction. A contractor found 8
to have committed an infraction under RCW 18.106.020 must be assessed 9
a minimum monetary penalty of ((five hundred dollars )) $500 for the 10
first infraction. The maximum penalty for an infraction under RCW 11
18.106.020 must not exceed ((five thousand dollars )) $5,000 for a 12
second or subsequent infraction. The department shall set by rule a 13
schedule of penalties for infractions imposed under this chapter.14
(2) The administrative law judge may not waive, reduce, or 15
suspend the monetary penalty imposed for the infraction.16
(3) The director may waive or reduce collection of payment for 17
good cause. 18
(4)(a) Any individual or plumbing contractor who ((acquires)) is 19
determined by final order to have committed three infractions 20
involving residential service plumbing or construction performed on a 21

residential structure within a ((thirty-six)) 36-month period may 1
have his or her certificate, license, endorsement, or registration 2
suspended for a period of up to two years upon recommendation of the 3
advisory board of plumbers. For purposes of this subsection, multiple 4
infractions or violations created by a single inspection or audit are 5
counted as one ((violation)) infraction. 6
(b) If an individual or plumbing contractor is determined by 7
final order to have committed five or more infractions within a five-8
year period, the department may issue an order suspending the 9
individual's or contractor's certificate, license, endorsement, or 10
registration for up to two years. The order must set forth each of 11
the infractions that form the basis of the suspension. The suspension 12
must be measured from the date of the department's final order. The 13
department may issue other appropriate remedies, such as requiring an 14
individual or plumbing contractor to submit a corrective action plan 15
addressing the deficiencies that led to the infractions before the 16
certificate, license, endorsement, or registration may be reinstated. 17
For purposes of this subsection, multiple infractions or violations 18
created by a single inspection or audit are counted as one 19
infraction. This subsection (4)(b) does not apply to infractions 20
involving residential service plumbing or construction performed on a 21
residential structure.22
(5) Monetary penalties collected under this chapter shall be 23
deposited in the plumbing certificate fund. 24
