  • (1) Every person who sells, furnishes, 3 administers, distributes, gives away, or offers to sell, furnish, 4 administer, distribute, or give away a device, canister, tank, or 5 receptacle either exclusively containing nitrous oxide or flavored 6 nitrous oxide or exclusively containing a chemical compound mixed 7 with nitrous oxide, is guilty of a gross misdemeanor.8 (2) This section does not apply to any person who administers 9 nitrous oxide for the purpose of providing medical, veterinary, or 10 dental care, if administered by a medical, veterinary, or dental 11 practitioner licensed by this state or at the direction or under the 12 supervision of a practitioner licensed by the state.13 (3) This section does not apply to the sale of nitrous oxide 14 contained in food products for use as a propellant.15 (4) This section does not apply to the sale and use of nitrous 16 oxide by a manufacturer as part of a manufacturing process or 17 industrial operation.

AN ACT Relating to the sale and distribution of nitrous oxide; 1
adding a new section to chapter 69.50 RCW; and prescribing penalties.2
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:3
NEW SECTION. Sec. 1. A new section is added to chapter 69.50 4
RCW to read as follows: 5
(1) Every person who sells, furnishes, administers, distributes, 6
gives away, or offers to sell, furnish, administer, distribute, or 7
give away a device, canister, tank, or receptacle either exclusively 8
containing nitrous oxide or flavored nitrous oxide or exclusively 9
containing a chemical compound mixed with nitrous oxide, is guilty of 10
a gross misdemeanor. 11
(2) This section does not apply to any person who administers 12
nitrous oxide for the purpose of providing medical or dental care, if 13
administered by a medical or dental practitioner licensed by this 14
state or at the direction or under the supervision of a practitioner 15
licensed by the state. 16
(3) This section does not apply to the sale of nitrous oxide 17
contained in food products for use as a propellant.18
(4) This section does not apply to the sale and use of nitrous 19
oxide by a manufacturer as part of a manufacturing process or 20
industrial operation. 21
