AN ACT Relating to patient access to elective percutaneous 1
coronary interventions in ambulatory surgical facilities; and 2
amending RCW 70.38.128. 3
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:4
Sec. 1. RCW 70.38.128 and 2007 c 440 s 1 are each amended to 5
read as follows: 6
(1) To promote the stability of Washington's cardiac care 7
delivery system, ((by July 1, 2008, the department of health shall 8
adopt)) the department of health shall:9
(a) Adopt rules establishing criteria for the issuance of a 10
certificate of need under this chapter for the performance of 11
elective percutaneous coronary interventions at hospitals that do not 12
otherwise provide on-site cardiac surgery; and13
(b) By July 1, 2027, adopt rules establishing criteria for the 14
issuance of a certificate of need under this chapter for the 15
performance of elective percutaneous coronary interventions at 16
ambulatory surgical facilities. 17
(2) Prior to initiating rule making under subsection (1) of this 18
section, the department shall contract for an independent evidence-19
based review of the circumstances under which elective percutaneous 20
coronary interventions should be allowed in Washington at hospitals 21

that do not otherwise provide on-site cardiac surgery. The review 1
shall address, at a minimum, factors related to access to care, 2
patient safety, quality outcomes, costs, and the stability of 3
Washington's cardiac care delivery system and of existing cardiac 4
care providers, and ensure that elective coronary intervention 5
volumes at the University of Washington academic medical center are 6
maintained at levels required for training of cardiologists 7
consistent with applicable accreditation requirements. The department 8
shall consider the results of this review, and any associated 9
recommendations, in adopting these rules. 10
