AN ACT Relating to contracts between the United States and county 1
and municipal jails for committing or confining individuals in 2
federal custody; and amending RCW 70.48.140. 3
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:4
Sec. 1. RCW 70.48.140 and 1977 ex.s. c 316 s 14 are each amended 5
to read as follows: 6
(1) A person having charge of a jail ((shall)) may choose to 7
receive and keep in such jail, when room is available, all persons 8
confined or committed thereto by process or order issued under 9
authority of the United States until discharged according to law, the 10
same as if such persons had been committed under process issued under 11
authority of the state ((, if provision is made by the United States 12
for the support of such persons confined, and for any additional 13
personnel required )). Except for when there is a valid judicial 14
warrant issued, any such agreement shall be made by a contract with 15
the United States to confine or commit individuals in a jail and 16
entered into prior to the jail accepting any person in federal 17
custody.18
(2) Any contract shall include a fee of the total cost to the 19
jail to confine or commit an individual in federal custody. If at any 20
point funds are not received from the United States or there is an 21

indication that funds will not be received from the United States and 1
given to the local county or municipality, according to the contract, 2
then the jail shall no longer agree to hold federal detainees.3
(3) Except for when a valid judicial warrant has been issued, no 4
county or municipality may contract the use of their jail with the 5
United States to confine or commit an individual that has been 6
transported across any state line.7
