AN ACT Relating to state and local law enforcement interactions 1
with federal immigration enforcement officials; and adding a new 2
section to chapter 10.93 RCW. 3
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:4
NEW SECTION. Sec. 1. A new section is added to chapter 10.93 5
RCW to read as follows: 6
(1) Whenever an on-duty general authority Washington peace 7
officer or on-duty limited authority Washington peace officer 8
encounters an individual the peace officer has reasonable suspicion 9
is a United States immigration and customs enforcement employee 10
conducting immigration enforcement activities, the peace officer 11
shall: 12
(a) Activate the peace officer's body worn camera if the peace 13
officer is equipped with a body worn camera; 14
(b) Activate the peace officer's dash camera if the peace officer 15
is in the peace officer's official vehicle and if the vehicle is 16
equipped with a dash camera; 17
(c) Immediately report the encounter to the peace officer's 18
employing agency so the agency may notify the community in a manner 19
consistent with the agency's policies and procedures; and20

(d) After the encounter, document and report the encounter with 1
the peace officer's employing agency. 2
(2) When documenting and reporting activities under subsection 3
(1) of this section, the peace officer shall attempt to:4
(a) Contact the reporting party, if any; 5
(b) Confirm the identity of the individual the peace officer 6
suspects is conducting immigration enforcement by requesting official 7
identification, if safe and feasible; and 8
(c) Refrain from taking actions that may escalate the situation. 9
(3) The office of the attorney general shall represent a peace 10
officer in any civil or criminal proceeding arising from any actions 11
taken by the peace officer in compliance with this section if the 12
action was taken in good faith while the peace officer was acting 13
within the peace officer's scope of employment. The attorney 14
general's representation under this subsection must be provided at no 15
cost to the peace officer. 16
(4) The state shall indemnify and hold harmless a peace officer 17
in the amount of any judgment or fine levied against the peace 18
officer in any civil or criminal proceeding arising from any actions 19
taken by the peace officer in compliance with this section if the 20
action was taken in good faith while the peace officer was acting 21
within the peace officer's scope of employment. 22
