AN ACT Relating to requiring certain disclosures from private 1
entities that receive state funding; and adding a new chapter to 2
Title 19 RCW. 3
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:4
NEW SECTION. Sec. 1. (1) All private entities that seek, either 5
as a grantee or a subgrantee, a grant that is funded in whole or in 6
part by state funds must disclose on a form approved by the office of 7
financial management as part of their application for grant funding 8
or upon renewal of grant funding the following information:9
(a) The name and total compensation of each employee of the 10
private entity whose total compensation exceeds $100,000 annually;11
(b) The name of each employee who currently or within the past 12
five years has held public office within Washington state regardless 13
of compensation amount; 14
(c) The name of each board member of the private entity and any 15
compensation paid to each board member; 16
(d) Any political contributions made by the private entity in the 17
previous four election cycles reportable under Title 29B RCW; and18
(e) An accounting of how the grant money will be spent by the 19
private entity. 20

(2) Any agency that awards, either directly or as pass-through 1
funding, a grant that is funded in whole or in part by state funds 2
must: 3
(a) Provide applicants with the disclosure form approved by the 4
office of financial management as part of the application or renewal 5
process; 6
(b) Ensure that grantees and subgrantees are fully in compliance 7
with subsection (1) of this section; and 8
(c) Immediately upon awarding or renewing a grant, transmit all 9
completed disclosure forms, including those from unsuccessful 10
applicants, required under subsection (1) of this section to the 11
office of financial management. 12
(3) Noncompliance with subsection (1) of this section must result 13
in forfeiture of the award and the noncompliant private entity shall 14
reimburse the grantor the complete amount of the funds awarded to, 15
and received by, the entity. 16
(4) The office of financial management shall maintain a publicly 17
searchable database on its website for all completed disclosure 18
forms. 19
(5) The following definitions apply throughout this section 20
unless the context clearly requires otherwise: 21
(a)(i) "Agency" includes all state agencies and all local 22
agencies. 23
(ii) "State agency" includes every state office, department, 24
division, bureau, board, commission, or other state agency.25
(iii) "Local agency" includes every county, city, town, municipal 26
corporation, quasi-municipal corporation, or special purpose 27
district, or any office, department, division, bureau, board, 28
commission, or agency thereof, or other local public agency.29
(b) "Private entity" means any nonpublic entity organized under 30
26 U.S.C. Sec. 501(c). 31
(c) "Public office" has the meaning defined in RCW 29B.10.440.32
NEW SECTION. Sec. 2. Section 1 of this act constitutes a new 33
chapter in Title 19 RCW.34
