AN ACT Relating to establishing guidelines for what constitutes a 1
socially disadvantaged individual for the purpose of business 2
enterprise state certification; and amending RCW 39.19.120.3
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:4
Sec. 1. RCW 39.19.120 and 1987 c 328 s 7 are each amended to 5
read as follows: 6
(1) The office shall be the sole authority to perform 7
certification of minority business enterprises, socially and 8
economically disadvantaged business enterprises, and women's business 9
enterprises throughout the state of Washington. Certification by the 10
state office will allow these firms to participate in programs for 11
these enterprises administered by the state of Washington, any city, 12
town, county, special purpose district, public corporation created by 13
the state, municipal corporation, or quasi-municipal corporation 14
within the state of Washington. 15
(2) This statewide certification process will prevent duplication 16
of effort, achieve efficiency, and permit local jurisdictions to 17
further develop, implement, and/or enhance comprehensive systems of 18
monitoring and compliance for contracts issued by their agencies.19

(3) For purposes of state certification, it is rebuttably 1
presumed that the following individuals are socially disadvantaged 2
individuals:3
(a) Women;4
(b) Persons who are Black/African American, Hispanic/Latino, 5
Native American, Asian, Pacific Islander, Native Hawaiian, or Middle 6
Eastern/North African;7
(c) LGBTQ individuals; and8
(d) Any other group as determined by the office by rule to be 9
socially disadvantaged.10
