AN ACT Relating to imposing a business and occupation tax 1
surcharge on the operators of private detention facilities; and 2
adding a new section to chapter 82.04 RCW. 3
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:4
NEW SECTION. Sec. 1. A new section is added to chapter 82.04 5
RCW to read as follows: 6
(1) Beginning July 1, 2026, in addition to all other taxes 7
imposed under this chapter, persons must pay a surcharge on 8
Washington taxable income arising from operating a private detention 9
facility as defined in RCW 70.395.020 if the person has annual 10
Washington gross receipts in excess of $1,000,000.11
(2) The rate of the surcharge is one percent of taxable income 12
attributable to the operation of a private detention facility.13
