AN ACT Relating to the immediate use of marriage licenses for 1
medical necessity; amending RCW 26.04.180; and creating a new 2
section. 3
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:4
Sec. 1. RCW 26.04.180 and 1985 c 82 s 4 are each amended to read 5
as follows: 6
(1) The county auditor may issue the marriage license at the time 7
of application, but shall issue such license no later than the third 8
full day following the date of the application. A marriage license 9
issued pursuant to the provisions of this chapter may not be used 10
until three days after the date of application and shall become void 11
if the marriage is not solemnized within ((sixty)) 60 days of the 12
date of the issuance of the license, and the county auditor shall 13
notify the applicant in writing of this requirement at the time of 14
issuance of the license. 15
(2) The county auditor shall issue the marriage license at the 16
time of application, and such license may be used immediately, in the 17
event that a written statement from a physician licensed to practice 18
medicine in the state is first provided to the county auditor, which 19
states that one or both of the applicants is at risk of imminent 20
death or incapacity.21
