AN ACT Relating to transferring ownership of the Naselle Youth 1
Camp property to the Chinook Indian Nation; amending RCW 28A.190.005 2
and 72.05.010; and creating a new section. 3
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:4
NEW SECTION. Sec. 1. The legislature intends to transfer 5
ownership of the Naselle Youth Camp property to the Chinook Indian 6
Nation in order to realize the highest and best use of an 7
underutilized asset for the local community and the people. By 8
October 1, 2025, the department of enterprise services must execute 9
an agreement to transfer title of the property from the state to the 10
Chinook Indian Nation without further consideration if the Chinook 11
Indian Nation agrees to maintain ownership of the property for a 12
minimum of 10 years and to use the property for tribal government 13
purposes.14
Sec. 2. RCW 28A.190.005 and 2021 c 164 s 3 are each amended to 15
read as follows: 16
The definitions in this section apply throughout this chapter 17
unless the context clearly requires otherwise. 18
(1) "Institutional education facility" means residential 19
habilitation and child study and treatment centers operated by the 20

department of social and health services, state long-term juvenile 1
institutions operated by the department of children, youth, and 2
families, state-operated community facilities, county juvenile 3
detention centers, and facilities of the department of corrections 4
that incarcerate juveniles committed as adults. 5
(2) "Institutional education program" means the program of 6
education that is provided to youth in institutional education 7
facilities as a mandatory component of the program of basic education 8
under RCW 28A.150.200. 9
(3) "Institutional education provider" or "provider" means a 10
school district, educational service district, or other entity 11
providing education services to youth in an institutional education 12
facility. 13
(4) "Postresident youth" means a person who is under the age of 14
21 and a former resident of an institutional education facility. A 15
postresident youth may be a public school student or a person who is 16
eligible to be a public school student but who is not enrolled in a 17
school or otherwise receiving basic education services.18
(5) "Residential school" means the following institutional 19
education facilities: Green Hill school, ((Naselle Youth Camp,)) Echo 20
Glen, Lakeland Village, Rainier school, Yakima Valley school, 21
Fircrest school, the Child Study and Treatment Center and Secondary 22
School of western state hospital, and other schools, camps, and 23
centers established by the department of social and health services 24
or the department of children, youth, and families for the diagnosis, 25
confinement, and rehabilitation of juveniles committed by the courts 26
or for the care and treatment of persons who are exceptional in their 27
needs by reason of mental or physical deficiency. "Residential 28
school" does not include the state schools for the blind, the 29
Washington state center for childhood deafness and hearing loss, or 30
adult correctional institutions. 31
(6) "School district" has the same meaning as in RCW 28A.315.025 32
and includes any educational service district that has entered into 33
an agreement to provide a program of education for residents at an 34
institutional education facility on behalf of the school district as 35
a cooperative service program pursuant to RCW 28A.310.180.36
(7) "Youth" means a person who is under the age of 21 who is a 37
resident of an institutional education facility. A youth may be a 38
public school student or a person who is eligible to be a public 39

school student but who is not enrolled in a school or otherwise 1
receiving basic education services. 2
Sec. 3. RCW 72.05.010 and 2020 c 274 s 54 are each amended to 3
read as follows: 4
(1) The purposes of ((RCW 72.05.010)) this section and RCW 5
72.05.020 through 72.05.210 are: To provide for every child with 6
behavior problems, persons with disabilities, and hearing and 7
visually impaired children, within the purview of ((RCW 72.05.010)) 8
this section and RCW 72.05.020 through 72.05.210, as now or hereafter 9
amended, such care, guidance and instruction, control and treatment 10
as will best serve the welfare of the child or person and society; to 11
insure nonpolitical and qualified operation, supervision, management, 12
and control of the Green Hill school, ((the Naselle Youth Camp, )) 13
Echo Glen, Lakeland Village, Rainier school, the Yakima Valley 14
school, Fircrest school, the Child Study and Treatment Center and 15
Secondary School of western state hospital, and like residential 16
state schools, camps, and centers hereafter established; and to 17
provide for the persons committed or admitted to those schools that 18
type of care, instruction, and treatment most likely to accomplish 19
their rehabilitation and restoration to normal citizenship.20
(2) To further such purposes, Green Hill School, Echo Glen, 21
((Naselle Youth Camp, )) and such other juvenile rehabilitation 22
facilities, as may hereafter be established, are placed under the 23
department of children, youth, and families; Lakeland Village, 24
Rainier school, the Yakima Valley school, Fircrest school, the Child 25
Study and Treatment Center and Secondary School of western state 26
hospital, and like residential state schools, camps, and centers, 27
hereafter established, are placed under the department of social and 28
health services. 29
