AN ACT Relating to modifying the reimbursement rates for services 1
related to institutions; amending RCW 72.72.030 and 72.72.040; and 2
creating a new section. 3
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:4
Sec. 1. RCW 72.72.030 and 2017 3rd sp.s. c 6 s 714 are each 5
amended to read as follows: 6
(1) There is hereby created, in the state treasury, an 7
institutional impact account. The secretary of children, youth, and 8
families ((may)) shall reimburse political subdivisions for criminal 9
justice costs incurred directly as a result of crimes committed by 10
offenders residing in an institution as defined herein under the 11
jurisdiction of the secretary of children, youth, and families. Such 12
reimbursement shall be made to the extent funds are available from 13
the institutional impact account. Reimbursements shall be limited to 14
law enforcement, prosecutorial, judicial, and jail facilities costs 15
which are documented to be strictly related to the criminal 16
activities of the offender. 17
(2) The secretary of corrections ((may)) shall reimburse 18
political subdivisions for criminal justice costs incurred directly 19
as a result of crimes committed by offenders residing in an 20
institution as defined herein under the jurisdiction of the secretary 21

jail facilities costs which are documented to be strictly related to 4
the criminal activities of the offender. 5
Sec. 2. RCW 72.72.040 and 2017 3rd sp.s. c 6 s 715 are each 6
amended to read as follows: 7
(1) The secretary of children, youth, and families and the 8
secretary of corrections shall each promulgate rules pursuant to 9
chapter 34.05 RCW regarding the reimbursement process for their 10
respective agencies. 11
(2) The office of financial management shall promulgate rules, 12
pursuant to chapter 34.05 RCW, establishing rates of reimbursement 13
for law enforcement, prosecutorial, judicial, and jail facilities 14
costs, under this chapter. The office of financial management shall 15
establish a rate for each county where institutions are located.16
(a) The rates for law enforcement, prosecutorial, and judicial 17
costs shall be based upon the average hourly cost, in each county, 18
from the last closed state fiscal year period.19
(b) The rate for jail facilities costs shall be based upon the 20
average daily bed rate, in each county, from the last closed state 21
fiscal year period.22
(3) Reimbursement shall not be made if otherwise provided 23
pursuant to other provisions of state law. 24
NEW SECTION. Sec. 3. Both the secretary of children, youth, and 25
families and the secretary of corrections shall repromulgate rules to 26
conform with this act.27
