AN ACT Relating to medicaid coverage for HIV antiviral drugs; 1
adding a new section to chapter 74.09 RCW; providing an effective 2
date; and declaring an emergency. 3
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:4
NEW SECTION. Sec. 1. A new section is added to chapter 74.09 5
RCW to read as follows: 6
(1) The authority shall provide coverage under this chapter for 7
all federal food and drug administration approved HIV antiviral drugs 8
without prior authorization or step therapy. This coverage must be 9
provided to apple health clients enrolled in both fee-for-service and 10
managed care programs. 11
(2) Upon initiation or renewal of a contract with the authority 12
to administer a medicaid managed care plan, a managed health care 13
system shall provide coverage without prior authorization or step 14
therapy for all federal food and drug administration approved HIV 15
antiviral drugs. 16
NEW SECTION. Sec. 2. This act is necessary for the immediate 17
preservation of the public peace, health, or safety, or support of 18
S-0668.2
