AN ACT Relating to project permit applications for residential 1
housing units; and adding a new section to chapter 36.70B RCW.2
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:3
NEW SECTION. Sec. 1. A new section is added to chapter 36.70B 4
RCW to read as follows: 5
(1) A proposed project to provide one or more residential housing 6
units within the incorporated areas in an urban growth area 7
designated pursuant to RCW 36.70A.110, shall be considered under the 8
zoning or other land use control ordinances in effect on the subject 9
location at the time a fully completed project permit application has 10
been submitted to the appropriate city official. 11
(2) The requirements for a fully completed application shall be 12
defined by local ordinance. 13
(3) A local ordinance or regulation may allow the jurisdiction's 14
processing and review of a permit to be paused until applicable fees 15
are paid and notices are posted or delivered. However, a project 16
permit application is not deemed invalid or incomplete for the 17
purpose of subsection (1) of this section on the basis that an 18
applicable fee has not been paid or an applicable notice has not been 19
posted or delivered. 20
