AN ACT Relating to improving access to abortion medications; 1
amending RCW 72.09.780; and declaring an emergency.2
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:3
Sec. 1. RCW 72.09.780 and 2025 c 424 s 1912 are each amended to 4
read as follows: 5
(1) The department is authorized to acquire, receive, possess, 6
sell, resell, deliver, dispense, distribute, and engage in any 7
activity constituting the practice of pharmacy or wholesale 8
distribution with respect to abortion medications. 9
(2) The department may exercise the authority granted in this 10
section for the benefit of any person, whether or not the person is 11
in the custody or under the supervision of the department.12
(3) The department shall exercise the authority granted in this 13
section in accordance with any applicable law including, but not 14
limited to, any applicable licensing requirements, except that the 15
department is exempt from obtaining a wholesaler's license for any 16
actions taken pursuant to chapter 195, Laws of 2023 as provided in 17
RCW 18.64.046. 18
(4)(((a))) The department shall establish and operate a program 19
to deliver, dispense, and distribute abortion medications described 20
in this section. In circumstances in which the department is selling, 21

delivering, or distributing abortion medications to a health care 1
provider or health care entity, it may only sell, distribute, or 2
deliver abortion medications to health care providers and health care 3
entities that will only use the medications for the purposes of 4
providing reproductive health care including abortion care or medical 5
management of early pregnancy loss. The department shall coordinate 6
with the department of health to identify appropriate recipients of 7
the abortion medications and prioritize bulk distribution to health 8
care providers and health care entities. The department may but is 9
not required to obtain any payment for delivering, dispensing, or 10
distributing abortion medications or engaging in any other activity 11
under this section.12
(((b) Except as provided in (c) of this subsection, any abortion 13
medications sold, resold, delivered, dispensed, or distributed 14
whether individually or wholesale shall be conducted at cost not to 15
exceed list price, plus a fee of $5 per dose to offset the cost of 16
secure storage and delivery of medication. Revenues generated 17
pursuant to chapter 195, Laws of 2023 shall be deposited to the 18
general fund.19
(c) During the 2025 fiscal year, any abortion medications sold, 20
resold, delivered, dispensed, or distributed whether individually or 21
wholesale shall be conducted at cost not to exceed list price.))22
(5) Nothing in this section shall diminish any existing authority 23
of the department. 24
(6) For the purposes of this section, the following definitions 25
apply: 26
(a) "Abortion medications" means substances used in the course of 27
medical treatment intended to induce the termination of a pregnancy 28
or manage the full spectrum of reproductive health care including, 29
but not limited to, mifepristone and misoprostol. 30
(b) "Deliver" has the same meaning as in RCW 18.64.011.31
(c) "Dispense" has the same meaning as in RCW 18.64.011.32
(d) "Distribute" has the same meaning as in RCW 18.64.011.33
(e) "Health care entity" means a hospital, clinic, pharmacy, 34
office, or similar setting where a health care provider provides 35
health care to patients. 36
(f) "Health care provider" has the same meaning as in RCW 37
70.02.010. 38
(g) "Person" has the same meaning as in RCW 18.64.011.39

(h) "Practice of pharmacy" has the same meaning as in RCW 1
18.64.011. 2
(i) "Wholesale distribution" has the same meaning as in WAC 3
246-945-001. 4
NEW SECTION. Sec. 2. This act is necessary for the immediate 5
preservation of the public peace, health, or safety, or support of 6
the state government and its existing public institutions, and takes 7
effect immediately.8
