adopted and, subject to the provisions set forth in this act, the 19
several dollar amounts hereinafter specified, or so much thereof as 20

2025-27 Behavioral Health Facilities (40000667)6
The appropriation in this section is subject to the following 7
conditions and limitations: 8
(1) The appropriation in this section is provided solely for the 9
department to issue grants to community hospitals or other community 10
providers to expand and establish new and preserve existing capacity 11
for behavioral health services in communities. The department must 12
consult an advisory group consisting of representatives from the 13
department of social and health services, the health care authority, 14
one representative from a managed care organization, one 15
representative from an accountable care organization, and one 16
representative from the association of county human services. The 17
amounts provided in this section may be used for construction and 18
equipment costs associated with establishment or preservation of the 19
facilities. The department may approve funding for the acquisition of 20
a facility if the project will result in increased behavioral health 21
capacity. Amounts provided in this section may not be used for 22
operating costs associated with the treatment of patients using these 23
services. 24
(2) The department must establish criteria for the issuance of 25
the grants, which must include: 26
(a) Evidence that the application was developed in collaboration 27
with one or more regional behavioral health entities that administer 28
the purchasing of services; 29
(b) Evidence that the applicant has assessed and would meet gaps 30
in the geographical availability and service needs of behavioral 31
health services in their region; 32
(c) Evidence that the applicant is able to meet applicable 33
licensing and certification requirements in the facility that will be 34
used to provide services; 35
(d) A commitment by applicants to serve persons who are publicly 36
funded and persons detained for involuntary commitment, as applicable 37
by facility type, under chapter 71.05 RCW; 38

(e) A commitment by the applicant to maintain and operate the 1
beds or facility for a time period commensurate to the state 2
investment, but for at least a 10-year period; 3
(f) The date upon which structural modifications or construction 4
would begin and the anticipated date of completion of the project;5
(g) A detailed estimate of the costs associated with opening the 6
beds; 7
(h) A financial plan demonstrating the applicant's ability to 8
maintain and operate the facility; and 9
(i) The applicant's commitment to work with local courts and 10
prosecutors as applicable to ensure that prosecutors and courts in 11
the area served by the hospital or facility will be available to 12
conduct involuntary commitment hearings and proceedings under chapter 13
71.05 RCW. 14
(3) In awarding funding for projects in subsection (5) of this 15
section, the department, in consultation with the advisory group 16
established in subsection (1) of this section, must strive for 17
geographic distribution and to allocate funding based on population 18
and service needs of an area. The department must consider current 19
services available, anticipated services available based on projects 20
underway, and the service delivery needs of an area.21
(4) The department must prioritize projects that increase 22
capacity in unserved and underserved areas of the state.23
(5) (($70,000,000)) $66,700,000 of the state building 24
construction account— state appropriation in this section is provided 25
solely for competitive community behavioral health grants to address 26
regional needs and noncompetitive closure prevention grants. Closure 27
prevention grants must be awarded on a first-come, first-served 28
basis. For competitive regional needs grants, priority must be given 29
to: Youth and adult bed capacity with consideration given to gaps 30
identified in the 2024 behavioral health capital grant facility 31
funding report; and facilities that serve specialized populations, 32
including, but not limited to, services for individuals with 33
traumatic brain injury, dementia, and cooccurring complex needs of 34
youth. Additional categories of facilities may be funded based on 35
identified needs of a region. Eligible facilities include, but are 36
not limited to: 37
(a) Crisis relief centers and stabilization facilities that offer 38
access to mental health and substance use care for no more than 23 39
hours and 59 minutes per patient, at a time, and are not subject to 40

federal funding restrictions that apply to institutions of mental 1
diseases; 2
(b) Mental health peer respite centers that are not subject to 3
federal funding restrictions that apply to institutions of mental 4
diseases. No more than one mental health peer respite center should 5
be funded in each of the 10 regions; 6
(c) Grants to community providers to increase long-term intensive 7
inpatient psychiatric treatment services and capacity for children 8
and minor youth including, but not limited to, services for substance 9
use disorder treatment, sexual assault and traumatic stress, anxiety, 10
or depression, and interventions for children exhibiting aggressive 11
or depressive behaviors in facilities that are not subject to federal 12
funding restrictions; 13
(d) Grants to community hospitals, freestanding evaluation and 14
treatment providers, or freestanding psychiatric hospitals to develop 15
capacity for beds to serve individuals on 90-day or 180-day civil 16
commitments as an alternative to treatment in the state hospitals. In 17
awarding this funding, the department must coordinate with the 18
department of social and health services, the health care authority, 19
and the department of health and must only select facilities that 20
meet the following conditions: 21
(i) The funding must be used to increase capacity related to 22
serving individuals who will be transitioned from or diverted from 23
the state hospitals; 24
(ii) The facility is not subject to federal funding restrictions 25
that apply to institutions of mental diseases; 26
(iii) The provider has submitted a proposal for operating the 27
facility to the health care authority; 28
(iv) The provider has demonstrated to the department of health 29
and the health care authority that it is able to meet the applicable 30
licensing and certification requirements for the facility that will 31
be used to provide services; and 32
(v) The health care authority has confirmed that it intends to 33
contract with the facility for operating costs within funds provided 34
in the operating budget for these purposes; 35
(e) Enhanced adult residential care facilities for long-term 36
dementia placements discharged or diverted from the state psychiatric 37
hospitals and are not subject to federal funding restrictions that 38
apply to institutions of mental diseases; 39

(f) Facilities that provide substance use disorder intervention, 1
assessment, and treatment services with secure withdrawal management 2
and stabilization treatment beds that are not subject to federal 3
funding restrictions that apply to institutions of mental diseases; 4
and 5
(g) Facilities where behavioral health supportive services, such 6
as harm reduction and physical health services, are offered within 7
the same facility as behavioral health services and that are not 8
subject to federal funding restrictions that apply to institutions of 9
mental diseases. 10
(6) $10,000,000 of the state building construction account — state 11
appropriation in this section is provided solely for one crisis 12
stabilization facility in the King county region consistent with the 13
settlement agreement in A.B., by and through Trueblood, et al., v. 14
DSHS, et al. , No. 15-35462, that is not subject to federal funding 15
restrictions that apply to institutions of mental disease. In 16
awarding this funding, the department must coordinate with the health 17
care authority and the King county behavioral health administrative 18
service organization and must only select a facility that has been 19
selected by King county's crisis care centers initiative as the 20
crisis care center for the south King county region.21

(9) During the 2025-2027 fiscal biennium, where the department 37
has awarded a grant for the operation of a crisis diversion or 38
stabilization facility located in Pierce county that is not subject 39

to federal funding restrictions that apply to institutions of mental 1
diseases, the department may amend the contract associated with the 2
grant in order to authorize the facility to be used for any community 3
development block grant national objective. 4
(10) The department shall notify all applicants that they may be 5
required to have a construction review performed by the department of 6
health. 7
(11) To accommodate the emergent need for behavioral health 8
services, the department and the department of health, in 9
collaboration with the health care authority and the department of 10
social and health services, must establish a concurrent and expedited 11
process to assist grant applicants in meeting any applicable 12
regulatory requirements necessary to operate inpatient psychiatric 13
beds, freestanding evaluation and treatment facilities, enhanced 14
services facilities, triage facilities, crisis stabilization 15
facilities, or secure detoxification/secure withdrawal management and 16
stabilization facilities. 17
(12) In contracts for grants authorized under this section, the 18
department must include provisions that require that the grantee or 19
successor hold the capital improvements for at least a 10-year 20
period. The provisions must require the facility to be used for 21
behavioral health services, but may allow the facility to change 22
ownership or facility type during the commitment period. The 23
department shall monitor the activities of recipients of grants under 24
this program to determine compliance with the terms and conditions 25
set forth in its contract. 26
(13) The department must provide a progress report to the 27
appropriate committees of the legislature by November 1, 2026. The 28
report must include: 29
(a) The total number of applications and amount of funding 30
requested; 31
(b) A list and description of the projects approved for funding 32
including state funding, total project cost, services anticipated to 33
be provided, bed capacity, and anticipated completion date;34
(c) A statewide map of new capacity since 2018, including 35
projected bed capacity and opening dates; 36
(d) A status report of projects that received funding in prior 37
funding rounds, including details about the project completion and 38
the date the facility began providing services; and39

(e) Recommendations for statutory language that would codify the 1
grant program on an ongoing basis including: 2
(i) Evaluation and prioritization criteria; 3
(ii) Monitoring and compliance requirements; 4
(iii) Preconstruction and technical assistance services; and5
(iv) Data needed to determine the service needs by area of the 6
state. 7
(14) The department must coordinate with the health care 8
authority and department of health to submit capital budget requests 9
to fund behavioral health community capacity grants for the 2027-2029 10
biennial budget by the due date established by the office of 11
financial management. Associated state budget operating costs must 12
also be identified and requested. 13
(15) The appropriation in this section is subject to the 14
provisions of section 8018 of this act. 15

2025-27 Connecting Housing to Infrastructure Program (40000675)24
The appropriation in this section is subject to the following 25
conditions and limitations: 26
(1)(a) The appropriation in this section is provided solely for 27
grants or deferred loans to local governments and public utility 28
districts to defray the cost of waiving a portion of or all of the 29
fees normally applied to developers for utility connection charges 30
and related street improvements related to new affordable housing 31
projects for low- and moderate-income households. 32
(b) Where applicable, the utility extension and related street 33
improvements must be consistent with the approved comprehensive plans 34
under the growth management act and must be within the established 35
boundaries of the urban growth area as set forth in the approved 36
comprehensive plans. Street improvements are eligible if the 37
improvements are related directly to the utility extension or 38

connection and are adjacent to the new housing units being 1
constructed. 2
(c) Projects must be located within a jurisdiction that imposes a 3
sales and use tax under RCW 82.14.530(1)(a)(ii) or (b)(i)(B), 4
82.14.540, or 84.52.105. 5
(2)(a) $30,000,000 of the state building construction account — 6
state appropriation is provided solely for grants or deferred loans 7
for system development charges, utility improvements, and street 8
improvements associated with utility infrastructure for affordable 9
housing projects serving low-income households located within a city 10
or county with a population of 150,000 or fewer persons.11
(b) $5,000,000 of the state building construction account — state 12
appropriation in this section is provided for the department for 13
pilot grants for system development charges, utility improvements, 14
and street improvements associated with utility infrastructure for 15
affordable housing projects serving moderate-income households. The 16
pilot program must be offered in three counties located in the north 17
central region of the state. The counties must share borders with one 18
another, be located east of the crest of the Cascade mountains, and 19
each have a population of 85,000 persons or fewer. By June 1, 2027, 20
the department must submit a report to the office of financial 21
management and to the appropriate committees of the legislature that:22
(i) Summarizes the results of the pilot program, including an 23
analysis of the need for infrastructure assistance for local 24
governments to support the development of housing affordable to 25
moderate-income households, and the benefits to communities that may 26
result from increasing economic diversity in housing that is made 27
more affordable through infrastructure subsidies; 28
(ii) Describes the number and total dollar amount of application 29
requests and funding awards; and 30
(iii) Makes recommendations regarding continuation or expansion 31
of the pilot program and recommended future funding levels.32
(3) To be eligible for funding under this section, an applicant 33
must demonstrate, at minimum: 34
(a) That affordable housing development will begin construction 35
within 24 months of the grant or loan award; and 36
(b) A strong probability of serving the original target group or 37
income level for a period of at least 25 years. 38
(4) For purposes of this section, the following definitions 39
apply. 40

(a) "Affordable housing" means residential housing that requires 1
payment of monthly housing costs, including utilities other than 2
telephone, of no more than 30 percent of the household's income.3
(b) "Low-income household" has the same meaning as in RCW 4
43.185A.010. 5
(c) "Moderate-income household" means: For purposes of the pilot 6
program authorized in this section, a single person, family, or 7
unrelated persons living together whose adjusted income is above 80 8
percent of the median household income adjusted for family size, for 9
the county where the affordable housing project is located, but less 10
than the state median income, as reported by the United States 11
department of housing and urban development. 12
(d) "System development charges" means charges for new utility 13
improvements. 14
(e) "Utility improvements" means drinking water, wastewater, or 15
stormwater utility improvements. 16
(5) $10,000,000 of the appropriation in this section is provided 17
solely for the Fort Lawton redevelopment project. The funding 18
provided in this subsection is not subject to the provisions of 19
subsection (3) of this section. The legislature intends to provide 20
funds in the amount of $10,000,000 in the 2027-2029 fiscal biennium 21
to the Fort Lawton redevelopment project. 22
(6) The appropriation in this section is subject to the 23
provisions of section 8018 of this act. 24

The appropriations in this section are subject to the following 34
conditions and limitations: 35
(1) (($133,000,000)) $216,770,000 of the state building 36
construction account — state and (($402,000,000)) $530,730,000 of the 37

state taxable building construction account — state appropriations are 1
provided solely for the new construction, acquisition, or acquisition 2
and rehabilitation of affordable housing projects that serve and 3
benefit low-income and special needs populations including, but not 4
limited to, people with chronic mental illness or behavioral health 5
conditions, farmworkers, people who are homeless, and people in need 6
of permanent supportive housing. The department shall strive to 7
invest at least 20 percent of the appropriation provided under this 8
section with by and for organizations, as defined by the office of 9
equity. Of the amounts provided in this subsection (1):10
(a) (($53,000,000)) $55,070,000 of the state building 11
construction account — state and (($162,000,000)) $229,430,000 of the 12
state taxable building construction account — state appropriations are 13
provided solely for multifamily rental housing projects. For each 14
affordable housing development project, the department may finance up 15
to a total of $10,000,000 in construction awards, including prior 16
biennia awards.17
(b) $50,000,000 of the state taxable building construction 18
account— state appropriation is provided solely for affordable housing 19
projects that serve and benefit low-income people with developmental 20
or intellectual disabilities. The department must use a separate 21
application form and evaluation criteria for applications under this 22
subsection. The department must coordinate with the department of 23
social and health services regarding any needed supportive services 24
and make efforts to enact the recommendations of the housing needs 25
study for individuals with intellectual and developmental 26
disabilities, as provided in section 1068 (6), chapter 332, Laws of 27
2021. The department must consider prioritizing funding under this 28
subsection for housing that serves individuals who are exiting 29
residential habilitation centers or facilities. 30
(c) $100,000,000 of the state taxable building construction 31
account— state appropriation is provided ((solely)) for permanent 32
supportive housing projects in accordance with the apple health and 33
homes rapid permanent supportive housing program created in RCW 34
43.330.187. Of the amounts provided in this subsection (1)(c), 35
$4,250,000 is provided solely for the Maple Court Permanent 36
Supportive Housing project. 37
(d) (($30,000,000)) $61,700,000 of the state building 38
construction account — state appropriation and (($45,000,000)) 39

$86,300,000 of the state taxable building construction account — state 1
appropriation in this section are provided solely for the development 2
of homeownership projects affordable to first-time low-income 3
households. Projects serving homebuyers whose income is up to 80 4
percent of the area median income, adjusted for household size for 5
the county where the property is located are eligible to apply, 6
except that projects located in rural areas of the state, as defined 7
by the department, serving homebuyers whose income is up to 100 8
percent of the area median income, adjusted for household size for 9
the county where the property is located are eligible to apply. 10
Eligible activities include, but are not limited to, down payment 11
assistance, closing costs, acquisition, rehabilitation costs, and new 12
construction. The department shall strive to invest at least 20 13
percent of these funds with by and for organizations, as defined by 14
the office of equity, and make efforts to enact the recommendations 15
of the homeownership disparities work group created in section 16
128(100), chapter 297, Laws of 2022. 17
Of the amounts provided in this subsection (1)(d), $2,500,000 of 18
the state building construction account — state appropriation is 19
provided solely for the Orchard Gardens project , and $8,000,000 of 20
the state taxable building construction account — state appropriation 21
is provided solely for the Kulshan Community Land Trust: Thornton 22
Village Ferndale project. 23
(e)(((i)(A) $17,500,000)) $30,000,000 of the state taxable 24
building construction account — state appropriation is provided solely 25
((for the northwest cooperative development center to provide 26
subgrants)) to provide grants for the acquisition and preservation of 27
mobile or manufactured home communities where at least 50 percent of 28
the preserved homes are and will remain occupied by low-income 29
households. Funding provided under this subsection (1)(e)(((i))) may 30
be used for the purpose of avoiding household displacement due to 31
sale or other transactions and ensuring preservation of housing 32
affordability for low-income households for a minimum of 40 years and 33
may be awarded only to eligible organizations as defined in RCW 34
59.20.030. 35
(((B))) Of the amounts provided in this subsection (e), 36
$17,500,000 of the state taxable building construction account — state 37
appropriation is provided solely for the northwest cooperative 38
development center to provide subgrants for the purposes of this 39

subsection, and $2,500,000 of the state taxable building construction 1
account— state appropriation is provided solely for the Bayside 2
Housing project. 3
(((ii) $10,000,000)) (f) $20,000,000 of the state taxable 4
building construction account — state appropriation is provided solely 5
((for the northwest cooperative development center to provide 6
subgrants)) to provide grants to organizations that are mobile home 7
park cooperatives or manufactured housing cooperatives, as those 8
terms are defined in RCW 59.20.030, for critical improvements, 9
repairs, and infrastructure upgrades to promote the preservation of 10
mobile or manufactured home communities as affordable housing. The 11
grantee must award subgrants based on needs relating to health, 12
safety, and cost for resident-owned manufactured housing community 13
cooperatives in Washington. 14
Of the amounts provided in this subsection (f), $10,000,000 of 15
the state taxable building construction account — state appropriation 16
is provided solely for the northwest cooperative development center 17
to provide subgrants for the purposes of this subsection.18
(((f))) (g) $10,000,000 of the state taxable building 19
construction account — state appropriation is provided solely for 20
eligible organizations under RCW 43.185A.040 to acquire, acquire and 21
renovate, or prepare real property for rapid conversion into 22
permanent supportive housing, transitional housing, indoor emergency 23
housing, tiny homes, or indoor emergency shelters, with a primary 24
focus on serving people with extremely low-incomes who are 25
experiencing sheltered and unsheltered homelessness, including 26
families with children, unaccompanied youth and young people, older 27
adults, and people with disabilities. Acquisitions completed with 28
temporary financing are eligible for funding provided in this 29
section. The department may approve funding only for projects that 30
result in increased shelter or housing capacity for extremely low-31
income people and households. In awarding funding pursuant to this 32
subsection (1)(((f))) (g), the department shall prioritize the 33
acquisition of multifamily housing units and housing projects that 34
rapidly move people experiencing sheltered or unsheltered 35
homelessness into housing, including, but not limited to, individuals 36
living in unsanctioned encampments, the public rights-of-way, or 37
other public spaces. Amounts provided in this subsection (1)(((f))) 38

(g) may not be used for operating or maintenance costs, supportive 1
services, or debt service. 2
(((g) $50,000,000)) (h) $100,000,000 of the state building 3
construction account — state appropriation is provided solely for 4
affordable housing preservation projects, which may include, but are 5
not limited to: 6
(i) Projects preserving and extending the affordability 7
commitment period for projects in the housing trust fund portfolio. 8
The funds may be provided for major building improvements, 9
preservation, and system replacements, necessary for the existing 10
housing trust fund portfolio to maintain its long-term viability. The 11
department must require a capital needs assessment be provided before 12
contract execution. Funds may not be used to add or expand the 13
capacity of the property. When allocating funds, the department must 14
prioritize buildings that are older than 15 years and that serve very 15
low-income and extremely low-income populations. 16
(ii) Projects preserving affordable multifamily housing at risk 17
of losing its affordability due to expiration of use restrictions 18
that otherwise require affordability including, but not limited to, 19
United States department of agriculture funded multifamily housing. 20
The department must prioritize projects that satisfy the goal of 21
long-term preservation of Washington's affordable multifamily housing 22
stock, particularly in rural areas of the state. Funds may be used 23
for acquisition or for acquisition and rehabilitation of properties 24
to preserve the affordable housing units beyond their existing use 25
restrictions and place them in Washington's housing trust fund 26
portfolio for a minimum of 40 years. If a capital needs assessment is 27
required, the department must work with the applicant to ensure that 28
this does not create an unnecessary impediment to rapidly accessing 29
these funds. 30
(iii) Projects rehabilitating affordable multifamily housing 31
impacted by the weather event described in the governor's emergency 32
proclamation 25-07.33
(iv) The funding provided under this subsection (((g))) (h) is 34
not subject to the 60-day application period in RCW 43.185A.150.35
(((h))) (i) $5,000,000 of the state taxable building construction 36
account— state appropriation in this section is provided solely for 37
facilities housing low-income migrant, seasonal, or temporary 38
farmworkers. The department shall prioritize funding of projects to 39
areas of highest need. Funding may also be provided, to the extent 40

qualified projects are submitted, for projects that address health 1
and safety. 2
(((i))) (j) The department shall strive to invest at least 10 3
percent of the appropriations provided under (a) and (d) of this 4
subsection (1) for either affordable multifamily rental housing or 5
homeownership projects, or both, benefiting low-income households in 6
federally recognized Indian tribes in the state of Washington. The 7
department must conduct a separate application process and use 8
separate evaluation criteria to solicit tribal housing projects and 9
prioritize projects to tribal communities of highest need.10
(2) (($3,000,000)) $4,500,000 of the state building construction 11
account— state appropriation is provided solely for the department to 12
provide preconstruction and technical assistance awards in accordance 13
with RCW 43.185A.170. By January 1, 2027, the department must provide 14
the governor and the appropriate committees of the legislature with a 15
progress report for entities receiving awards made under this 16
subsection (2). The progress report must list which entities applied 17
for, and were successful in securing, additional financing for the 18
construction or preservation of affordable housing.19
(3) $5,000,000 of the state building construction account — state 20
appropriation in this section is provided solely for affordable 21
housing urgent repair grants to be provided on an ongoing basis. 22
Funding is not subject to the 60-day notification requirement in RCW 23
43.185A.150. The funding may be provided to address nonrecurring 24
repair projects including repair of units or buildings, abatement of 25
potentially hazardous materials, and safety-related structural 26
improvements of affordable housing. Each repair grant award may not 27
exceed $200,000 per award. However, the department may not limit the 28
number of awards or amount received per organization.29
(a) For purposes of this subsection (3), "affordable housing" 30
means: 31
(i) Permanent supportive housing as defined in RCW 36.70A.030; 32
and 33
(ii) Multifamily affordable housing projects in the housing trust 34
fund portfolio. 35
(b) If the department receives application requests that exceed 36
the appropriation level in this subsection (3), the department must 37
prioritize projects under (a)(i) of this subsection (3).38

The appropriation in this section is subject to the following 16
conditions and limitations: 17
(1) $26,000,000 of the state building construction account — state 18
appropriation in this section is provided solely for competitive 19
grants to eligible entities for predevelopment, design, and 20
construction of projects that provide a public benefit through 21
research, development, demonstration, or deployment of clean energy 22
technologies that save energy and reduce energy costs, reduce harmful 23
air emissions, or increase energy independence for the state. 24
Priority must be given to projects that benefit vulnerable 25
populations and overburdened communities, including tribes.26
(2) Entities eligible for grant funding under this section 27
include local governments, federally recognized tribal governments 28
and tribes' contracted service providers, public and private 29
utilities that serve retail customers in the state, for-profit 30
entities, research institutions, nonprofit organizations, and state 31
agencies. 32
(3) To be eligible, a project must be consistent with the state 33
energy strategy adopted under chapter 43.21F RCW and policies under 34
chapter 19.405 RCW. To the extent practicable, the department must 35
prioritize projects that build upon Washington's strengths in 36
aerospace, maritime, information and communications technology, grid 37

modernization, advanced materials, and decarbonizing the built 1
environment. 2
(4) The department must invite stakeholders to participate in the 3
design and implementation of grant programs funded under this 4
section. The department must consider equity and environmental 5
justice when developing the program structure and opportunities for 6
applicant participation. 7
(5) When soliciting and evaluating proposals, awarding contracts, 8
and monitoring projects under this section, the department must:9
(a) Ensure that competitive processes, rather than sole source 10
contracting processes, are used to select all projects;11
(b) Ensure that a public benefit results from the use of public 12
funds through due diligence and monitoring of contracted projects, 13
including ensuring compliance with all applicable laws related to the 14
project selection process, project monitoring, and contracting; and15
(c) Prioritize projects for funding that leverage the greatest 16
amount of matching funds, such as local levy funding.17
(6)(a) The department must require project applicants to:18
(i) Disclose all sources of public funding invested in a project; 19
and 20
(ii) Identify by name any former or current state of Washington 21
employees employed by the applicant or its governing body in the 24 22
months preceding the application submittal. The identification must 23
include the person's separation date and job title or position held. 24
If the department determines that a conflict of interest or other 25
violation of chapter 42.52 RCW exists, the application must be 26
disqualified from further consideration. 27
(b) If, after a grant has been awarded, the department finds that 28
a grantee has violated chapter 42.52 RCW, either in procuring or 29
performing under the grant, the department in its sole discretion may 30
terminate the grant funding by written notice. If the grant is 31
terminated, the department must reserve its right to pursue all 32
available remedies under law to address the violation.33
(7) The department must specify the requirements in subsections 34
(5) and (6) of this section in funding contracts entered into by the 35
department under this section. 36
(8) $5,000,000 of the state building construction account — state 37
appropriation and $30,000,000 of the climate commitment account— state 38
appropriation in this section ((is)) are provided solely for grants 39
to tribes for clean energy development projects. Eligible uses of 40

grant funding include planning, predesign, design, construction, 1
project predevelopment, and deployment of clean energy projects that 2
contribute to achieving the state's greenhouse gas emissions 3

The appropriation in this section is subject to the following 31
conditions and limitations: 32
(1) $11,500,000 of the appropriation in this section is provided 33
solely to the department of commerce for a grant to the Washington 34
state green bank to provide agreements for residential credit 35
enhancements and commercial clean energy financing for projects that 36

address one or more purposes in subsection (2) of this section. In 1
contracts for grants to the Washington state green bank authorized 2
under this section, the department must include provisions that 3
require the Washington state green bank to remain an independent, 4
nonprofit corporation recognized as exempt from federal income 5
taxation for the public benefit during the term of the grant.6
(a) $3,000,000 of the appropriation in this subsection (1) is 7
provided solely for the Washington state green bank for agreements to 8
support a residential credit enhancement model that includes 9
partnerships with lenders and contractors to provide energy 10
efficiency upgrades, solar installations, electrical vehicle 11
chargers, and emergency HVAC replacements. Where possible and 12
feasible, energy efficiency upgrades should provide electric 13
equipment and infrastructure. Funding must prioritize low to 14
moderate-income families and households unable to access traditional 15
financing. Families and households above moderate income are eligible 16
but must not be prioritized. 17
(b) $8,500,000 of the appropriation in this subsection (1) is 18
provided solely for the Washington state green bank for agreements to 19
implement the requirements of subsections (3)(a)(iii) and (iv) of 20
this section for commercial energy efficiency, including, but not 21
limited to, meeting clean buildings performance standard compliance 22
and helping small businesses and tribes in procuring clean energy and 23
pursuing fleet electrification projects. 24
(2) Projects funded by this section must meet one or more of the 25
following objectives: 26
(a) Promoting investments in qualified clean energy projects;27
(b) Increasing significantly the pace and level of investments in 28
qualified clean energy projects at the state and local levels;29
(c) Improving the standard of living of the residents of 30
Washington state by promoting the more efficient and lower cost 31
development of qualified clean energy projects and providing 32
financing for qualified clean energy projects that will create high-33
paying, long-term jobs; 34
(d) Fostering the development and consistent application of 35
transparent underwriting standards, standard contractual terms, and 36
measurement and verification protocols for qualified clean energy 37
projects; 38
(e) Promoting the creation of performance data that enables 39
effective underwriting, risk management, and pro forma modeling of 40

financial performance of qualified clean energy projects to support 1
primary financing markets and to stimulate the development of 2
secondary investment markets for qualified clean energy projects; and3
(f) Achieving a level of financing support for qualified clean 4
energy projects necessary to help abate climate change through 5
development, demonstration, and deployment of clean energy 6
technologies that save energy and reduce energy costs, reduce harmful 7
air emissions, or increase energy independence for the state. 8
Priority must be given to projects that benefit vulnerable 9
populations, including tribes and communities with high environmental 10
or energy burdens, and complement and supplement other clean energy 11
and energy efficiency programs and initiatives in this state;12
(3)(a) In grants to the Washington state green bank authorized 13
under this section, the department must include provisions that 14
require the Washington state green bank to establish guidelines, 15
screening processes, and evaluation and selection criteria to be used 16
by lenders operating under the credit enhancement model. For all 17
other applicants and project types, the Washington state green bank 18
shall directly offer financial products and structures, including 19
soliciting and evaluating project proposals and monitoring projects 20
under this section. For grants authorized under this section, the 21
department of commerce must require the Washington state green bank 22
to: 23
(i) Ensure that selective processes and criteria, rather than 24
sole source contracting processes, are used to select all lender 25
partners, contractors, and projects, except as otherwise noted in 26
this section; 27
(ii) Conduct due diligence activities associated with the use of 28
public funds including, but not limited to, oversight of the project 29
selection process, project monitoring, and ensuring that all 30
applications and contracts fully comply with all applicable laws 31
including disclosure and conflict of interest statutes;32
(iii) Develop rules, policies, and procedures that specify the 33
eligibility of borrowers and any other terms or conditions of the 34
financial support to be provided by the Washinton state green bank 35
before financing support is provided for any qualified clean energy 36
project; 37
(iv) Develop and offer a range of financing structures, forms, 38
and techniques for qualified clean energy projects, including, but 39

not limited to, loans, credit enhancements, guarantees, warehousing, 1
securitization, and other financial products and structures;2
(v) Leverage private investment in qualified clean energy 3
projects through financing mechanisms that support, enhance, and 4
complement private investment; 5
(vi) Ensure that financing entities providing funds under this 6
section provide funding in a reasonable and transparent manner that 7
is in the financial interest of the borrowers and is consistent with 8
state consumer protection standards; and 9
(vii) Assess reasonable fees for the financing support and risk 10
management activities provided by the Washington state green bank.11
(b) After the original amount of all funds appropriated under 12
subsection (1) of this section have been lent out by the Washington 13
state green bank, the funds revolved are not subject to Executive 14
Order 21-02 or prevailing wage requirements; 15
(4)(a) Consistent with chapter 42.52 RCW, the ethics in public 16
service act, a project applicant must identify in application 17
materials any state of Washington employees or former state employees 18
employed by the firm or on the firm's governing board during the past 19
24 months. Application materials must identify the individual by 20
name, the agency previously or currently employing the individual, 21
job title, or position held, and separation date. If it is determined 22
by the department of commerce or the Washington state green bank that 23
there is a conflict of interest or situation that is likely to 24
constitute a violation of the chapter 42.52 RCW, the applicant may be 25
disqualified from further consideration for award of funding.26
(b) If the department of commerce or the Washington state green 27
bank finds, after due notice and examination, that there is a 28
conflict of interest or a situation that is likely to constitute a 29
violation of chapter 42.52 RCW, or any similar statute, involving a 30
recipient of funding under this section, the department of commerce 31
or the Washington state green bank may terminate the funding 32
agreement in its sole discretion by written notice with a reservation 33
of rights to pursue all available remedies under law to address the 34
violation. 35
(5) Requirements in subsection (4) of this section must be 36
specified in funding agreements issued by the department of commerce 37
and the Washington state green bank. 38
(6) $1,000,000 of the appropriation in this section is provided 39
solely for a grant to the Washington state green bank for program 40

administration costs. In the grant authorized under this subsection, 1
the department of commerce must include provisions that require the 2
Washington state green bank to: 3
(a) Collect and make available to the public in a centralized 4
database on an internet website maintained by the Washington state 5
green bank information regarding rates, terms, and conditions of all 6
financing support transactions, unless the disclosure of such 7
information includes a trade secret, confidential commercial 8
information, or confidential financial information;9
(b) Work with market and program participants to provide 10
information regarding best practices for overseeing qualified clean 11
energy projects and information regarding other appropriate consumer 12
protections; 13
(c) Prepare an annual report for the public on the financing 14
activities of the Washington state green bank, including other 15
sources of funding for the projects, for submittal to the governor 16
and appropriate committees of the legislature on November 1st of each 17
year, beginning fiscal year 2027; and 18
(d) Undertake such other activities as are necessary to carry out 19
the provisions of this section. 20
(7) The department may use up to three percent of amounts 21
appropriated in this section for administrative expenses.22

(1) The department may not expend the appropriation in this 34
section unless and until the nonstate share of project costs have 35
been either expended or firmly committed, or both, in an amount 36
sufficient to complete the project or a distinct phase of the project 37
that is useable to the public for the purpose intended by the 38

legislature. This requirement does not apply to projects where a 1
share of the appropriation is for design costs only.2
(2) Before receiving funds, project recipients must demonstrate 3
that the project site is under control for a minimum of 10 years, 4
either through ownership or a long-term lease. This requirement does 5
not apply to appropriations for preconstruction activities or 6
appropriations in which the sole purpose is to purchase real property 7
that does not include a construction or renovation component.8
(3) Projects funded in this section may be required to comply 9
with Washington's high performance building standards under chapter 10
39.35D RCW. 11
(4) Project funds are available on a reimbursement basis only and 12
may not be advanced under any circumstances. 13
(5) In contracts for grants authorized under this section, the 14
department shall include provisions that require that capital 15
improvements be held by the grantee for a specified period of time 16
appropriate to the amount of the grant and that facilities be used 17
for the express purpose of the grant. If the grantee is found to be 18
out of compliance with provisions of the contract, the grantee shall 19
repay to the state general fund the principal amount of the grant 20
plus interest calculated at the rate of interest on state of 21
Washington general obligation bonds issued most closely to the date 22

Capitol Lake-Deschutes Estuary Project (92000226)5
The appropriation in this section is subject to the following 6
conditions and limitations: 7
(1) The legislature finds that the portion of the capital campus 8
known as Capitol Lake is an important ecological and recreational 9
resource for the State of Washington that was once connected to the 10
Deschutes Estuary. Due to a lack of routine management over the last 11
25 to 50 years, the lake ecosystem is degraded, resulting in poor 12
water quality, excessive algae growth, and invasive species 13
proliferation. 14
The legislature further finds that the department of enterprise 15
services has conducted significant outreach and study by engaging 16
with the Squaxin Island Tribe, local municipal governments, the Port 17
of Olympia, and other local stakeholders towards the goal of a long-18
term management solution that returns the lake to an estuary. The 19
legislature acknowledges these efforts and partner commitments 20
towards contributing to future maintenance and renewal but recognizes 21
that the substantial investment necessary for the estuary restoration 22
plan as currently proposed is not feasible. In an effort to both 23
address the degraded lake water quality and identify a cost-effective 24
approach to an estuary restoration that the state can responsibly 25
support, the legislature intends to transfer management of this 26
aquatic ecosystem to a state agency with natural resources expertise. 27
Addressing the water quality of the lake will not only provide 28
immediate benefit to the health of Capitol Lake and Budd Inlet, but 29
also serve as a necessary precursor to a future estuary restoration.30
(2) (($8,000,000 of the )) The appropriations in this section 31
((is)) are provided solely for the department, in consultation with 32
the department of enterprise services and office of the governor, for 33
the Deschutes estuary restoration. The department shall use past 34
reports and studies, consider existing stakeholder input, and 35
critically consider elements of the current, but incomplete, 36
department of enterprise services design. The updated design must 37
include a recommended series of projects phased over several biennia 38

with defined deliverable outcomes that move the state forward to a 1
completed estuary. For each project phase, the plan shall identify 2
expected timelines, estimated expenditures, and opportunities for 3
non-state matching fund sources that contribute to the planned 4
restoration and construction costs. The design may include only those 5
elements associated with the construction of the estuary habitat, 6
roadway and bridge improvements necessary to remove the existing 5th 7
avenue bridge and associated necessary infrastructure and must 8
minimize overall project cost. Recreational or pedestrian enhancement 9
elements of the project must be designed as a separate bid package 10
that could be added to the project at a future date, subject to the 11
availability of funding appropriated for these elements.12

2025-27 Healthy Kids-Healthy Schools (40000147)6
The appropriation in this section is subject to the following 7
conditions and limitations: 8
(1)(a) $12,000,000 of the appropriation in this section is 9
provided solely for healthy kids and healthy schools grants for 10
projects that are consistent with the healthiest next generation 11
priorities. 12
(b) The appropriation in this subsection (1) is provided solely 13
for grant funding to school districts for the purchase of equipment 14
or to make repairs to existing equipment that is related to 15
improving: (i) Children's physical health, and may include, but is 16
not limited to, fitness playground equipment, covered play areas, and 17
physical education equipment or related structures or renovation; and 18
(ii) children's nutrition, and may include, but is not limited to, 19
garden related structures and greenhouses to provide students access 20
to fresh produce, and kitchen equipment or upgrades.21
(c) The office of the superintendent of public instruction shall 22
develop criteria for grant funding under this subsection (1) that 23
include, but are not limited to, the following requirements: (i) 24
Districts may apply for grants, but no single district may receive 25
more than $200,000 of the appropriation for grants awarded under this 26
section; (ii) any district receiving funding provided in this section 27
must demonstrate a consistent commitment to addressing school 28
facilities' needs; and (iii) applicants with a high percentage of 29
students who are eligible and enrolled in the free and reduced-price 30
meals program may be prioritized. 31
(2) (($1,000,000)) $3,500,000 of the appropriation in this 32
section is provided solely for grants to school districts, charter 33
schools, and state-tribal education compact schools for the 34
replacement of lead-contaminated pipes, drinking water fixtures, and 35
the purchase of water filters, including the labor costs of 36
remediation design, installation, and construction.37

The appropriations in this section are subject to the following 12
conditions and limitations: 13
(1) $174,450,000 of the state building construction account— state 14
appropriation and $70,832,000 of the common school construction 15
account— state appropriation in this section ((is)) are provided 16
solely for modernization grants for small school districts authorized 17
under RCW 28A.525.159. 18
(2) (($530,000)) $3,884,000 of the common school construction 19
account— state appropriation in this section is provided solely for 20
planning grants for small school districts authorized under RCW 21
28A.525.159. Planning grants may not exceed $50,000 per district. 22
Planning grants may only be awarded to school districts with an 23
estimated total project cost of $6,000,000 or less. In awarding 24
planning grants pursuant to this section, the office of the 25
superintendent of public instruction must follow the list of planning 26
grants submitted to the governor and the legislature for the 27
2025-2027 fiscal biennium, except that the office shall review the 28
planning grant list for project redundancies and may not award 29
planning grants for any project receiving design or construction 30
funding appropriated in other sections of part 5 of this act.31
(3) $27,371,000 of the state building construction account — state 32
appropriation in this section is provided solely for planning grants 33
and modernization grants to state-tribal compact schools. The 34
superintendent of public instruction may prioritize planning grants 35
for state-tribal compact schools with the most serious building 36
deficiencies and the most limited financial capacity.37

(4) The superintendent of public instruction shall submit a list 1
of small school district modernization projects, as prioritized by 2
the advisory committee under RCW 28A.525.159, to the legislature and 3
the governor by September 15, 2026. The list must include: (a) A 4
description of the project; (b) the proposed state funding level, not 5
to exceed $6,000,000 per project, adjusted for inflation based on the 6
office of financial management's C-100 form; (c) estimated total 7
project costs; and (d) local funding resources. 8
(5) In the 2025-2027 fiscal biennium, school districts receiving 9
a small district modernization grant under this section may not 10
combine this grant funding either with a school construction 11
assistance program grant or with other grants awarded under this 12
section to fund a single project. 13
(6) The appropriations in this section may be awarded only to 14
projects approved by the legislature, as identified in LEAP Capital 15
Document No. OSPI-1-2025, developed April 26, 2025 , and OFM Capital 16
Document No. 2026-2, developed December 22, 2025. 17

The appropriations in this section are subject to the following 17
conditions and limitations: 18
(1) It is the intent of the legislature to work with the office 19
of the superintendent of public instruction and stakeholders to 20
revise the school construction assistance program and to holistically 21
examine the state's programmatic support of K-12 school construction 22
through the planning process required under section 5011, chapter 23
375, Laws of 2024. Pursuant to this section, the legislature intends 24
that this revision and examination will be completed in a manner that 25
will modify and improve efficiencies within, and access to, the 26
school construction assistance program, while also identifying cost-27
saving measures for awarding state grants for the construction and 28
modernization of common school facilities. The legislature further 29
intends that this revision and planning process will result in a 30
prioritized list of school construction projects that recognizes the 31
substantial variation between district sizes and financial 32
capacities, and which categorizes reasonably comparable applicants 33
into distinct school district groupings to foster a fair and 34
equitable prioritization of projects. However, the legislature also 35
recognizes that some school district projects will be ready to 36
proceed to construction during this planning and revision period. 37
Therefore, the legislature intends to provide funding to the school 38

district projects listed in this section in recognition of this 1
transitional period. 2
(2) School districts receiving grant funding pursuant to this 3
section may combine this funding with a school construction 4
assistance program grant and must use available local resources to 5
contribute financially to the completion of the project.6

account— state appropriation in this section is provided solely for 8
the Pe Ell school district's K-12 school modernization project.9

RCW 43.88.031 requires the disclosure of the estimated debt 5
service costs associated with new capital bond appropriations. The 6
estimated debt service costs for the appropriations contained in this 7
act are (($73,258,483)) $46,425,516 for the 2025-2027 biennium, 8
(($410,061,655)) $390,379,123 for the 2027-2029 biennium, and 9
(($631,176,449)) $584,977,090 for the 2029-2031 biennium.10
Sec. 8002. 2025 c 414 s 8002 (uncodified) is amended to read as 11
follows: 12
(1) The following agencies may enter into financial contracts, 13
paid from any funds of an agency, appropriated or nonappropriated, 14
for the purposes indicated and in not more than the principal amounts 15
indicated, plus financing expenses and required reserves pursuant to 16
chapter 39.94 RCW. When securing properties under this section, 17
agencies shall use the most economical financial contract option 18
available, including long-term leases, lease-purchase agreements, 19
lease-development with option to purchase agreements or financial 20
contracts using certificates of participation. Expenditures made by 21
an agency for one of the indicated purposes before the issue date of 22
the authorized financial contract and any certificates of 23
participation therein are intended to be reimbursed from proceeds of 24
the financial contract and any certificates of participation therein 25
to the extent provided in the agency's financing plan approved by the 26
state finance committee. 27
(2) Those noninstructional facilities of higher education 28
institutions authorized in this section to enter into financial 29
contracts are not eligible for state funded maintenance and 30
operations. Instructional space that is available for regularly 31
scheduled classes for academic transfer, basic skills, and workforce 32
training programs may be eligible for state funded maintenance and 33
operations. 34
(3) Western Washington University: Enter into a financing 35
contract for up to $3,000,000 plus financing expenses, required 36

Sec. 8003. 2025 c 414 s 8004 (uncodified) is amended to read as 31
follows: 32
(1) The legislature finds that use of life-cycle cost analysis 33
will aid public entities, architects, engineers, and contractors in 34
making design and construction decisions that positively impact both 35
the initial construction cost and the ongoing operating and 36
maintenance cost of a project. To ensure that the total cost of a 37
project is accounted for and the most reasonable and cost efficient 38
design is used, agencies shall develop life-cycle costs for any 39

construction project over $10,000,000. The life-cycle costs must 1
represent the present value sum of capital costs, installation costs, 2
operating costs, and maintenance costs over the life expectancy of 3
the project. The legislature further finds the most effective 4
approach to the life-cycle cost analysis is to integrate it into the 5
early part of the design process. 6
(2) Agencies must develop a minimum of three project alternatives 7
for use in the life-cycle cost analysis. These alternatives must be 8
both distinctly different and viable solutions to the issue being 9
addressed. Agencies must choose the most reasonable and cost-10
effective solution, as supported by the life-cycle cost analysis. A 11
brief description of each project alternative and why it was chosen 12
must be included in the life-cycle cost analysis section of the 13
predesign. 14
(3) ((The office of financial management )) The department of 15
commerce shall: (a) Make available a life-cycle cost model to be used 16
for analysis; (b) in consultation with the department of enterprise 17
services, provide assistance in using the life-cycle cost model; and 18
(c) update the life-cycle cost model annually including assumptions 19
for inflation rates, discount rates, and energy rates.20
(4) Agencies shall consider architectural and engineering firms' 21
and general contractors' experience using life-cycle costs, operating 22
costs, and energy efficiency measures when selecting an architectural 23
and engineering firm, or when selecting contractors using alternative 24
contracting methods. 25
Sec. 8004. 2025 c 414 s 8016 (uncodified) is amended to read as 26
follows: 27
(1) For the 2025-2027 fiscal biennium, unless otherwise specified 28
for a single purpose in this act or chapter 414, Laws of 2025 , 29
agencies are appropriated one lump sum for minor works projects. It 30
is the intent of the legislature that appropriated funds be spent in 31
the biennium for which they are appropriated. 32
(2) Minor works projects may not exceed $4,000,000 for 33
institutions of higher education and $2,000,000 for all other 34
agencies. Administrative fees may not exceed four percent for each 35
project. 36
(3) Except as provided by the legislature, agencies are 37
encouraged to prioritize minor works projects based on:38
(a) Health and safety of employees or clients served;39

(b) The amount of use of a given facility or system;1
(c) The avoidance of future increased costs of repair or 2
maintenance; and 3
(d) The avoidance of increased operating costs.4
(4) Minor works appropriations may not be used for:5
(a) Projects that are a phase of a larger project, and that if 6
combined over a continuous period of time, would exceed the amounts 7
provided in subsection (2) of this section; 8
(b) Studies, planning, or design, except for technical or 9
engineering reviews or designs that lead directly to and support a 10
minor works project; 11
(c) Movable, temporary, and traditionally funded operating 12
equipment not in compliance with the equipment criteria established 13
by the office of financial management, including rolling stock and 14
computers; 15
(d) Software not dedicated to control of a specialized system;16
(e) Moving expenses; 17
(f) Land or facility acquisition; or 18
(g) Funding for projects with funding shortfalls unless expressly 19
authorized by the office of financial management for exigent 20
circumstances with notice to the legislative fiscal committees.21
(5) If a minor works appropriation does not specify it is to be 22
used for preservation or program improvements, up to 25 percent of 23
the appropriation may be used for program improvements. Improvements 24
for accessibility in compliance with the Americans with disabilities 25
act qualify as preservation improvements. 26
(6) Agencies must use reappropriations before newly appropriated 27
amounts without regard to lists or projects that were submitted at 28
the time the funds were appropriated. 29
(7) No later than ((December 15th )) October 1st of each even 30
numbered year, agencies must submit to the governor, house capital 31
budget committee, and senate ways and means committee, a list of 32
minor works projects completed or in progress for the current 33
biennium including: Project status, project cost, amount expended, 34
and amount encumbered for projects not yet complete.35
(8) Requests for minor works appropriations for the next biennium 36
must take into account minor works amounts to be reappropriated and 37
the amount of minor works projects that can reasonably be completed 38
in the next biennium. 39
