BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:29
NEW SECTION. Sec. 1. It is important that schools are provided 30
flexibility to determine how best to meet the needs of their students 31
and work with their local communities. It is the intent of the 32
legislature to provide schools increased flexibility by authorizing 33
school districts to grant waivers or partial waivers of state laws 34
and rules for schools located within the school district. 35
Additionally, the legislature intends to specifically authorize 36
school districts to use any savings resulting from not having to 37
implement a law or rule that was waived or partially waived. 38

However, for each waiver granted by the school district that results 1
in a savings, a portion of the savings must be awarded to each school 2
that requested the waiver and to any teacher at a school that brought 3
the idea to the principal to request the waiver. 4
NEW SECTION. Sec. 2. A new section is added to chapter 28A.320 5
RCW to read as follows: 6
(1) As specifically provided in chapters in this title, the board 7
of directors of each school district may grant waivers, or partial 8
waivers, of state laws and rules to individual schools within the 9
district. The school board shall grant waivers in accordance with 10
this section. 11
(2) To apply for a waiver, a school principal must submit an 12
application to the school district board of directors that identifies 13
the laws and rules requested to be waived and the rationale for the 14
request. The rationale must identify how granting the waiver will 15
improve student learning or the delivery of education services in the 16
school. 17
(3) The school district board of directors must provide time for 18
public review and comment regarding any waiver request at a regular 19
meeting of the school district board of directors.20
(4) The duration, renewal, and rescission of the waiver must be 21
determined by the school district board of directors.22
(5) The following may not be waived: 23
(a) Compliance with local, state, and federal health, safety, 24
parents' rights, civil rights, and nondiscrimination laws;25
(b) Provision of a program of basic education, that meets the 26
goals in RCW 28A.150.210; 27
(c) Employment of certificated instructional staff as required in 28
RCW 28A.410.025. However, school districts may hire noncertificated 29
instructional staff of unusual competence and in exceptional cases as 30
authorized in RCW 28A.150.203(7); 31
(d) Compliance with the employee record check requirements in RCW 32
28A.400.303; 33
(e) Adherence to generally accepted accounting principles and be 34
subject to financial examinations and audits as determined by the 35
state auditor, including annual audits for legal and fiscal 36
compliance; 37
(f) Compliance with the annual performance report under RCW 38
28A.655.110; 39

(g) Compliance with the open public meetings act in chapter 42.30 1
RCW and the public records act in chapter 42.56 RCW; and2
(h) Compliance with state and federal constitutional provisions.3
(6) A school district may not include provisions in a collective 4
bargaining agreement that limit the school district's authority to 5
grant waivers under this section. 6
(7) Each school district board of directors granting waivers of 7
state laws and rules shall submit to the superintendent of public 8
instruction and the state board of education a list of laws and rules 9
waived by the school district board of directors in accordance with 10
this section. 11
(8) School districts are authorized to use any savings resulting 12
from not having to implement a state law or rule waived by the school 13
district board of directors. However, each school district must award 14
a portion of the savings to the first school that requested the 15
waiver that resulted in a savings and to the first teacher at a 16
school who brought the idea to the principal to request the waiver. 17
No award may be granted in excess of $10,000 or 10 percent of the 18
actual net savings, whichever amount is less. No award may be granted 19
to a school in excess of 10 percent of the actual net savings, and no 20
amount may be granted to a teacher in excess of $10,000.21
NEW SECTION. Sec. 3. A new section is added to chapter 28A.150 22
RCW to read as follows: 23
Public schools may obtain, in accordance with section 2 of this 24
act, waivers from the statutory requirements in this chapter. Waivers 25
may also be obtained, in accordance with section 2 of this act, from 26
any rules of the state board of education and the superintendent of 27
public instruction adopted to implement the statutory requirements.28
NEW SECTION. Sec. 4. A new section is added to chapter 28A.155 29
RCW to read as follows: 30
Public schools may obtain, in accordance with section 2 of this 31
act, waivers from the statutory requirements in this chapter. Waivers 32
may also be obtained, in accordance with section 2 of this act, from 33
any rules of the state board of education and the superintendent of 34
public instruction adopted to implement the statutory requirements.35
NEW SECTION. Sec. 5. A new section is added to chapter 28A.160 36
RCW to read as follows: 37

Public schools may obtain, in accordance with section 2 of this 1
act, waivers from the statutory requirements in this chapter. Waivers 2
may also be obtained, in accordance with section 2 of this act, from 3
any rules of the state board of education and the superintendent of 4
public instruction adopted to implement the statutory requirements.5
NEW SECTION. Sec. 6. A new section is added to chapter 28A.165 6
RCW to read as follows: 7
Public schools may obtain, in accordance with section 2 of this 8
act, waivers from the statutory requirements in this chapter. Waivers 9
may also be obtained, in accordance with section 2 of this act, from 10
any rules of the state board of education and the superintendent of 11
public instruction adopted to implement the statutory requirements.12
NEW SECTION. Sec. 7. A new section is added to chapter 28A.170 13
RCW to read as follows: 14
Public schools may obtain, in accordance with section 2 of this 15
act, waivers from the statutory requirements in this chapter. Waivers 16
may also be obtained, in accordance with section 2 of this act, from 17
any rules of the state board of education and the superintendent of 18
public instruction adopted to implement the statutory requirements.19
NEW SECTION. Sec. 8. A new section is added to chapter 28A.175 20
RCW to read as follows: 21
Public schools may obtain, in accordance with section 2 of this 22
act, waivers from the statutory requirements in this chapter. Waivers 23
may also be obtained, in accordance with section 2 of this act, from 24
any rules of the state board of education and the superintendent of 25
public instruction adopted to implement the statutory requirements.26

NEW SECTION. Sec. 74. A new section is added to chapter 28A.715 27
RCW to read as follows: 28
State-tribal education compact schools may obtain, in accordance 29
with section 2 of this act, waivers from the statutory requirements 30
in this chapter. Waivers may also be obtained, in accordance with 31
section 2 of this act, from any rules of the state board of education 32
and the superintendent of public instruction adopted to implement the 33
statutory requirements. 34

Sec. 75. RCW 28A.405.060 and 1975 1st ex.s. c 275 s 132 are each 1
amended to read as follows: 2
(1) Except as specifically provided in chapters in this title, 3
certificated employees shall faithfully enforce in the common schools 4
the course of study and regulations prescribed, whether regulations 5
of the district, the superintendent of public instruction, or the 6
state board of education, and shall furnish promptly all information 7
relating to the common schools which may be requested by the 8
educational service district superintendent. 9
(2) Any certificated employee who wil lfully refuses or neglects 10
to enforce the course of study or the rules and regulations as above 11
in this section required, shall not be allowed by the directors any 12
warrant for salary due until said person shall have complied with 13
said requirements. 14
Sec. 76. RCW 41.56.906 and 2009 c 396 s 11 are each amended to 15
read as follows: 16
Nothing in this chapter may be construed to grant school district 17
employers or classified school district employees the right to reach 18
agreements that ((are in conflict with the termination provisions of 19
RCW 28A.400.320)) limit a school district employer's authority to 20
grant waivers under section 2 of this act. 21
Sec. 77. RCW 41.59.935 and 2017 3rd sp.s. c 13 s 706 are each 22
amended to read as follows: 23
(1) Nothing in this chapter grants employers or employees the 24
right to reach agreements regarding:25
(a) Salary or compensation increases for the state's statutory 26
program of basic education in excess of those authorized in 27
accordance with RCW 28A.150.410 and 28A.400.200; or28
(b) Limiting an employer's authority to grant waivers under 29
section 2 of this act. 30
(2) School districts are authorized to reach agreements regarding 31
salaries or compensation for enrichment activities subject to RCW 32
28A.400.200 and 28A.150.276. 33
NEW SECTION. Sec. 78. If any provision of this act or its 34
application to any person or circumstance is held invalid, the 35
remainder of the act or the application of the provision to other 36
persons or circumstances is not affected.37

NEW SECTION. Sec. 79. If any part of this act is found to be in 1
conflict with federal requirements that are a prescribed condition to 2
the allocation of federal funds to the state, the conflicting part of 3
this act is inoperative solely to the extent of the conflict and with 4
respect to the agencies directly affected, and this finding does not 5
affect the operation of the remainder of this act in its application 6
to the agencies concerned. Rules adopted under this act must meet 7
federal requirements that are a necessary condition to the receipt of 8
federal funds by the state.9
