AN ACT Relating to the annual reporting of information associated 1
with sales of vehicles subject to the advanced clean trucks 2
regulations; adding a new section to chapter 70A.30 RCW; creating a 3
new section; and providing an expiration date. 4
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:5
NEW SECTION. Sec. 1. (1) The legislature finds that:6
(a) The transition to zero emissions vehicles, including the 7
implementation of the advanced clean trucks regulations, represents a 8
shift in the Washington state's transportation and economic 9
landscape; 10
(b) While manufacturers are responding to this shift by offering 11
more zero emissions vehicles, there are some vehicle classes that are 12
not widely available for purchase in the state, such as heavy duty 13
vehicles. Moreover, even where a particular vehicle class is 14
available for a particular use, such as long-haul trucking or as a 15
recreational vehicle, the zero emissions option is insufficient 16
compared to the internal combustion engine option; and17
(c) Other states implementing the advanced clean trucks 18
regulations have reported a decline in sales and use tax revenue due 19
to vehicle availability and tax incentives encouraging the adoption 20
of zero emissions medium and heavy duty vehicles. 21

(2) Therefore, the legislature intends to ensure accountability 1
and data-driven policy making by requiring the joint legislative 2
audit and review committee to conduct an analysis of the advanced 3
clean trucks implementation, including its effect on state and local 4
sales and use tax collections. By establishing these reporting 5
requirements, the legislature intends to provide taxpayers, industry 6
stakeholders, and policymakers with the information necessary to meet 7
environmental goals while maintaining economic stability.8
NEW SECTION. Sec. 2. A new section is added to chapter 70A.30 9
RCW to read as follows: 10
(1) In accordance with this section and RCW 43.01.036, the joint 11
legislative audit and review committee, in consultation with the 12
department of revenue and the department of licensing, must annually 13
report to the appropriate committees of the legislature with 14
information on state and local sales and use tax collections 15
associated with in-state sales of regulated vehicles.16
(2) The annual report in subsection (1) of this section must 17
include, at a minimum, the following information: 18
(a) Annual sales of regulated vehicles in this state as compared 19
to prior calendar years; 20
(b) Annual state and local sales and use tax collections on in-21
state sales of regulated vehicles during the preceding calendar year;22
(c) Any changes in state and local sales and use tax collections 23
attributable to Washington state implementing the advanced clean 24
trucks regulations; 25
(d) If applicable, an analysis of the purchase price of regulated 26
vehicles as compared to nonregulated vehicles; 27
(e) To the extent practicable, a comparative analysis of state 28
and local tax collections in other states implementing the advanced 29
clean trucks regulations; 30
(f) Any information indicating changes in consumer behavior 31
attributable to Washington state implementing the advanced clean 32
trucks regulations; and 33
(g) Any other relevant information as determined by the joint 34
legislative audit and review committee, the department of revenue, or 35
the department of licensing. 36
(3) The department of revenue and the department of licensing 37
must cooperate with the joint legislative audit and review committee 38
to provide data necessary to complete the annual reports.39

(4) The joint legislative audit and review committee must submit 1
the report under this section to the appropriate committees of the 2
legislature by June 1, 2027, and by June 1st each year thereafter 3
until June 1, 2035. 4
(5) For the purposes of this section: 5
(a) "Advanced clean trucks regulations" means the regulations 6
adopted by the state of California (Cal. Code Regs. tit. 13, Secs. 7
1963-1963.5, as amended), which are adopted by reference by the 8
department of ecology under this chapter. 9
(b) "Regulated vehicle" means a motor vehicle subject to the 10
advanced clean trucks regulations. 11
(6) This section expires June 1, 2036. 12
