AN ACT Relating to requiring a performance audit of program 1
integrity measures in Washington's paid family and medical leave 2
program; adding a new section to chapter 50A.05 RCW; and providing an 3
expiration date. 4
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:5
NEW SECTION. Sec. 1. A new section is added to chapter 50A.05 6
RCW to read as follows: 7
(1) The state auditor shall conduct a performance audit of 8
program integrity measures in the state paid family and medical leave 9
program. The auditor may contract with an independent expert in state 10
programs that provide benefits to workers. 11
(2) The performance audit must: 12
(a) Evaluate the extent to which the department:13
(i) Has implemented program integrity measures including, but not 14
limited to, fraud protections, program misuse detection, coverage 15
eligibility verification standards, and enforcement mechanisms to 16
deny fraudulent claims; 17
(ii) Has implemented methods to recover benefit amounts to which 18
the individual is not entitled, including overpayments and benefits 19
obtained through fraudulent practices; and 20

(iii) Provides claim information to employers and employees that 1
supports the ability to determine whether a claim is valid including, 2
but not limited to, information on the duration and type of leave 3
requested and granted, the stated reason for requested leave, and the 4
amount of leave available to the employee after leave has been 5
granted; 6
(b) Determine if current program integrity measures, including 7
any fraud protection, program misuse detection, coverage eligibility 8
verification standards, and enforcement mechanisms to deny fraudulent 9
claims are the most effective and efficient available; and10
(c) Make recommendations regarding: 11
(i) Improvements to program integrity measures including, but not 12
limited to, changes to benefit application forms, coverage 13
eligibility verification standards, and enhanced enforcement 14
mechanisms to deny fraudulent claims; 15
(ii) Improvements to the department's benefit recovery methods;16
(iii) Improvements to department communications and reports to 17
employers and employees that promote program integrity and the 18
ability to determine whether a claim is valid; and19
(iv) Any legislative or administrative changes necessary to 20
implement the recommendations. 21
(3) The state auditor shall submit progress reports by December 22
1, 2026, and June 30, 2027, and the results of the audit by December 23
1, 2027, to the appropriate committees of the legislature.24
(4) This section expires December 31, 2027. 25
