AN ACT Relating to protecting critical infrastructure; amending 1
RCW 19.290.020, 19.290.030, 19.290.040, 19.290.080, 19.290.140, 2
9A.82.010, and 9.94A.515; adding new sections to chapter 9A.56 RCW; 3
and prescribing penalties. 4
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:5
Sec. 1. RCW 19.290.020 and 2024 c 301 s 4 are each amended to 6
read as follows: 7
(1) At the time of a transaction, every scrap metal business 8
doing business in this state shall produce wherever that business is 9
conducted an accurate and legible record of each transaction 10
involving nonferrous metal property. This record must be written in 11
the English language, documented on a standardized form or in 12
electronic form, and contain the following information:13
(a) The signature of the person with whom the transaction is 14
made; 15
(b) The time, date, location, and value of the transaction;16
(c) The name of the employee representing the scrap metal 17
business in the transaction; 18
(d) The name, street address, and telephone number of the person 19
with whom the transaction is made; 20

(e) The license plate number and state of issuance of the license 1
plate on the motor vehicle used to deliver the nonferrous metal 2
property subject to the transaction; 3
(f) A description of the motor vehicle used to deliver the 4
nonferrous metal property subject to the transaction;5
(g) The current driver's license number or other government-6
issued picture identification card number of the seller or a copy of 7
the seller's government-issued picture identification card; and8
(h) A description of the predominant types of nonferrous metal 9
property subject to the transaction, utilizing the institute of scrap 10
recycling industries' generally accepted terminology, and including 11
weight, quantity, or volume. 12
(2) For every transaction that involves nonferrous metal 13
property, every scrap metal business doing business in the state 14
shall require the person with whom a transaction is being made to 15
sign a declaration. The declaration may be included as part of the 16
transactional record required under subsection (1) of this section, 17
or on a receipt for the transaction. The declaration must state 18
substantially the following: 19
"I, the undersigned, affirm under penalty of law that the 20
property that is subject to this transaction is not to the best of my 21
knowledge stolen property." 22
The declaration must be signed and dated by the person with whom 23
the transaction is being made. An employee of the scrap metal 24
business must witness the signing and dating of the declaration and 25
sign the declaration accordingly before any transaction may be 26
consummated. 27
(3) The record and declaration required under this section must 28
be open to the inspection of any commissioned law enforcement officer 29
of the state or any of its political subdivisions at all times during 30
the ordinary hours of business, or at reasonable times if ordinary 31
hours of business are not kept, and must be maintained wherever that 32
business is conducted for five years following the date of the 33
transaction. 34
(4) It is unlawful to sell or offer to sell records of 35
transactions involving nonferrous metal property as described in this 36
section.37
Sec. 2. RCW 19.290.030 and 2024 c 301 s 5 are each amended to 38
read as follows: 39

(1) No scrap metal business may enter into a transaction to 1
purchase or receive nonferrous metal property from any person who 2
cannot produce at least one piece of current government-issued 3
picture identification, including a valid driver's license or 4
identification card issued by any state. 5
(2) No scrap metal business may purchase or receive commercial 6
metal property unless the seller: (a) Has a commercial account with 7
the scrap metal business; (b) can prove ownership of the property by 8
producing written documentation that the seller is the owner of the 9
property; or (c) can produce written documentation that the seller is 10
an employee or agent authorized to sell the property on behalf of a 11
commercial enterprise. 12
(3) No scrap metal business may enter into a transaction to 13
purchase or receive metallic wire that was burned in whole or in part 14
to remove insulation unless the seller can produce written proof to 15
the scrap metal business that the wire was lawfully burned.16
(4)(a) No transaction involving nonferrous metal property may be 17
made in cash or with any person who does not provide a street address 18
and photographic identification and sign a declaration under the 19
requirements of RCW 19.290.020 except as described in (b) of this 20
subsection. The person with whom the transaction is being made may 21
only be paid by a stored value device, electronic funds transfer, 22
other electronic payment method, or a nontransferable check, mailed 23
by the scrap metal business to a street address provided under RCW 24
19.290.020, no earlier than three days after the transaction was 25
made. A transaction occurs on the date provided in the record 26
required under RCW 19.290.020. 27
(b) A scrap metal business that is in compliance with this 28
chapter may pay up to a maximum of $30 in ((cash,)) a stored value 29
device((,)) or electronic funds transfer for nonferrous metal 30
property. The balance of the value of the transaction may be made by 31
nontransferable check, stored value device, or electronic funds 32
transfer at the time the transaction is made if the scrap metal 33
business digitally captures: 34
(i) A copy of one piece of current government-issued picture 35
identification, including a current driver's license or 36
identification card issued by any state; and 37
(ii) Either a picture or video of either the material subject to 38
the transaction in the form received or the material subject to the 39

transaction within the vehicle which the material was transported to 1
the scrap metal business. 2
(c) The requirements in this subsection do not apply to 3
transactions conducted between commercial accounts.4
(5)(a) A scrap metal business's usage of video surveillance shall 5
be sufficient to comply with subsection (4)(b)(ii) of this section so 6
long as the video captures the material subject to the transaction.7
(b) A digital image or picture taken under this section must be 8
available for two years from the date of transaction, while a video 9
recording must be available for 30 days. 10
(6) No scrap metal business may purchase or receive beer kegs 11
from anyone except a manufacturer of beer kegs or licensed brewery.12
Sec. 3. RCW 19.290.040 and 2024 c 301 s 6 are each amended to 13
read as follows: 14
(1) Every scrap metal business must create and maintain a 15
permanent record with a commercial enterprise, including another 16
scrap metal business, in order to establish a commercial account. 17
That record, at a minimum, must include the following information:18
(a) The full name of the commercial enterprise or commercial 19
account; 20
(b) The business address and telephone number of the commercial 21
enterprise or commercial account; and 22
(c) The full name of the person employed by the commercial 23
enterprise who is authorized to deliver nonferrous metal property and 24
commercial metal property to the scrap metal business.25
(2) The record maintained by a scrap metal business for a 26
commercial account must document every purchase or receipt of 27
nonferrous metal property and commercial metal property from the 28
commercial enterprise. The record must be maintained for three years 29
following the date of the transfer or receipt. The documentation must 30
include, at a minimum, the following information: 31
(a) The time, date, and value of the property being purchased or 32
received; 33
(b) A description of the predominant types of property being 34
purchased or received; and 35
(c) The signature of the person delivering the property to the 36
scrap metal business. 37
(3) It is unlawful to sell or offer to sell a record maintained 38
by a scrap metal business as described in this section.39

Sec. 4. RCW 19.290.080 and 2024 c 301 s 9 are each amended to 1
read as follows: 2
(1) Each violation of the requirements of this chapter that are 3
not subject to criminal penalties shall be a civil penalty punishable 4
by a fine of not more than $1,000. 5
(2) Within two years of a violation of any of the requirements of 6
this chapter that results in a civil penalty under this section, each 7
subsequent violation shall be punishable by a fine of not more than 8
$2,000. 9
(3)(a) A scrap metal business that engages in a pledge for, the 10
purchase of, or the trade of stolen copper that was used in 11
telecommunication cable, the theft of which can result in disruption 12
to emergency telecommunications services, is liable for a civil 13
penalty of:14
(i) Not more than $10,000 for a first violation; and15
(ii) Not more than $20,000 for a second violation.16
(b) A third violation of this subsection must result in loss of 17
licensure.18
Sec. 5. RCW 19.290.140 and 2013 c 322 s 16 are each amended to 19
read as follows: 20
(1) A license issued on the scrap metal license application 21
remains in force until suspended or revoked and may be renewed 22
annually upon reapplication and upon payment of the required fee. A 23
licensee who fails or neglects to renew the license before the 24
assigned expiration date shall pay the fee for an original scrap 25
metal license as provided in this chapter. 26
(2) Whenever a scrap metal processor, recycler, or supplier 27
ceases to do business as such or the license has been suspended or 28
revoked, the licensee shall immediately surrender the license to the 29
department of licensing. 30
(3) A scrap metal business that commits three violations under 31
RCW 19.290.080 must immediately surrender the license to the 32
department of licensing.33
Sec. 6. RCW 9A.82.010 and 2024 c 301 s 27 are each amended to 34
read as follows: 35
Unless the context requires the contrary, the definitions in this 36
section apply throughout this chapter. 37
(1)(a) "Beneficial interest" means: 38

(i) The interest of a person as a beneficiary under a trust 1
established under Title 11 RCW in which the trustee for the trust 2
holds legal or record title to real property; 3
(ii) The interest of a person as a beneficiary under any other 4
trust arrangement under which a trustee holds legal or record title 5
to real property for the benefit of the beneficiary; or6
(iii) The interest of a person under any other form of express 7
fiduciary arrangement under which one person holds legal or record 8
title to real property for the benefit of the other person.9
(b) "Beneficial interest" does not include the interest of a 10
stockholder in a corporation or the interest of a partner in a 11
general partnership or limited partnership. 12
(c) A beneficial interest is considered to be located where the 13
real property owned by the trustee is located. 14
(2) "Control" means the possession of a sufficient interest to 15
permit substantial direction over the affairs of an enterprise.16
(3) "Creditor" means a person making an extension of credit or a 17
person claiming by, under, or through a person making an extension of 18
credit. 19
(4) "Criminal profiteering" means any act, including any 20
anticipatory or completed offense, committed for financial gain, that 21
is chargeable or indictable under the laws of the state in which the 22
act occurred and, if the act occurred in a state other than this 23
state, would be chargeable or indictable under the laws of this state 24
had the act occurred in this state and punishable as a felony and by 25
imprisonment for more than one year, regardless of whether the act is 26
charged or indicted, as any of the following: 27
(a) Murder, as defined in RCW 9A.32.030 and 9A.32.050;28
(b) Robbery, as defined in RCW 9A.56.200 and 9A.56.210;29
(c) Kidnapping, as defined in RCW 9A.40.020 and 9A.40.030;30
(d) Forgery, as defined in RCW 9A.60.020 and 9A.60.030;31
(e) Theft, as defined in RCW 9A.56.030, 9A.56.040, 9A.56.060, 32
9A.56.080, and 9A.56.083; 33
(f) Unlawful sale of subscription television services, as defined 34
in RCW 9A.56.230; 35
(g) Theft of telecommunication services or unlawful manufacture 36
of a telecommunication device, as defined in RCW 9A.56.262 and 37
9A.56.264; 38
(h) Child selling or child buying, as defined in RCW 9A.64.030;39

(m) Extortionate extension of credit, as defined in RCW 11
9A.82.020; 12
(n) Advancing money for use in an extortionate extension of 13
credit, as defined in RCW 9A.82.030; 14
(o) Collection of an extortionate extension of credit, as defined 15
in RCW 9A.82.040; 16
(p) Collection of an unlawful debt, as defined in RCW 9A.82.045;17
(q) Delivery or manufacture of controlled substances or 18
possession with intent to deliver or manufacture controlled 19
substances under chapter 69.50 RCW; 20
(r) Trafficking in stolen property, as defined in RCW 9A.82.050;21
(s) Leading organized crime, as defined in RCW 9A.82.060;22
(t) Money laundering, as defined in RCW 9A.83.020;23
(u) Obstructing criminal investigations or prosecutions in 24
violation of RCW 9A.72.090, 9A.72.100, 9A.72.110, 9A.72.120, 25
9A.72.130, 9A.76.070, or 9A.76.180; 26
(v) Fraud in the purchase or sale of securities, as defined in 27
RCW 21.20.010; 28
(w) Promoting pornography, as defined in RCW 9.68.140;29
(x) Sexual exploitation of children, as defined in RCW 9.68A.040, 30
9.68A.050, and 9.68A.060; 31
(y) Promoting prostitution, as defined in RCW 9A.88.070 and 32
9A.88.080; 33
(z) Arson, as defined in RCW 9A.48.020 and 9A.48.030;34
(aa) Assault, as defined in RCW 9A.36.011 and 9A.36.021;35

(5) "Dealer in property" means a person who buys and sells 33
property as a business. 34
(6) "Debtor" means a person to whom an extension of credit is 35
made or a person who guarantees the repayment of an extension of 36
credit or in any manner undertakes to indemnify the creditor against 37
loss resulting from the failure of a person to whom an extension is 38
made to repay the same. 39

(7) "Documentary material" means any book, paper, document, 1
writing, drawing, graph, chart, photograph, phonograph record, 2
magnetic tape, computer printout, other data compilation from which 3
information can be obtained or from which information can be 4
translated into usable form, or other tangible item.5
(8) "Enterprise" includes any individual, sole proprietorship, 6
partnership, corporation, business trust, or other profit or 7
nonprofit legal entity, and includes any union, association, or group 8
of individuals associated in fact although not a legal entity, and 9
both illicit and licit enterprises and governmental and 10
nongovernmental entities. 11
(9) "Extortionate extension of credit" means an extension of 12
credit with respect to which it is the understanding of the creditor 13
and the debtor at the time the extension is made that delay in making 14
repayment or failure to make repayment could result in the use of 15
violence or other criminal means to cause harm to the person, 16
reputation, or property of any person. 17
(10) "Extortionate means" means the use, or an express or 18
implicit threat of use, of violence or other criminal means to cause 19
harm to the person, reputation, or property of any person.20
(11) "Financial institution" means any bank, trust company, 21
savings and loan association, savings bank, mutual savings bank, 22
credit union, or loan company under the jurisdiction of the state or 23
an agency of the United States. 24
(12) "Pattern of criminal profiteering activity" means engaging 25
in at least three acts of criminal profiteering, one of which 26
occurred after July 1, 1985, and the last of which occurred within 27
five years, excluding any period of imprisonment, after the 28
commission of the earliest act of criminal profiteering. In order to 29
constitute a pattern, the three acts must have the same or similar 30
intent, results, accomplices, principals, victims, or methods of 31
commission, or be otherwise interrelated by distinguishing 32
characteristics including a nexus to the same enterprise, and must 33
not be isolated events. However, in any civil proceedings brought 34
pursuant to RCW 9A.82.100 by any person other than the attorney 35
general or county prosecuting attorney in which one or more acts of 36
fraud in the purchase or sale of securities are asserted as acts of 37
criminal profiteering activity, it is a condition to civil liability 38
under RCW 9A.82.100 that the defendant has been convicted in a 39
criminal proceeding of fraud in the purchase or sale of securities 40

under RCW 21.20.400 or under the laws of another state or of the 1
United States requiring the same elements of proof, but such 2
conviction need not relate to any act or acts asserted as acts of 3
criminal profiteering activity in such civil action under RCW 4
9A.82.100. 5
(13) "Real property" means any real property or interest in real 6
property, including but not limited to a land sale contract, lease, 7
or mortgage of real property. 8
(14) "Records" means any book, paper, writing, record, computer 9
program, or other material. 10
(15) "Repayment of an extension of credit" means the repayment, 11
satisfaction, or discharge in whole or in part of a debt or claim, 12
acknowledged or disputed, valid or invalid, resulting from or in 13
connection with that extension of credit. 14
(16) "Stolen property" means property that has been obtained by 15
theft, robbery, or extortion. 16
(17) "To collect an extension of credit" means to induce in any 17
way a person to make repayment thereof. 18
(18) "To extend credit" means to make or renew a loan or to enter 19
into an agreement, tacit or express, whereby the repayment or 20
satisfaction of a debt or claim, whether acknowledged or disputed, 21
valid or invalid, and however arising, may or shall be deferred.22
(19) "Traffic" means to sell, transfer, distribute, dispense, or 23
otherwise dispose of stolen property to another person, or to buy, 24
receive, possess, or obtain control of stolen property, with intent 25
to sell, transfer, distribute, dispense, or otherwise dispose of the 26
property to another person. 27
(20)(a) "Trustee" means: 28
(i) A person acting as a trustee under a trust established under 29
Title 11 RCW in which the trustee holds legal or record title to real 30
property; 31
(ii) A person who holds legal or record title to real property in 32
which another person has a beneficial interest; or33
(iii) A successor trustee to a person who is a trustee under 34
(a)(i) or (ii) of this subsection. 35
(b) "Trustee" does not mean a person appointed or acting as:36
(i) A personal representative under Title 11 RCW;37
(ii) A trustee of any testamentary trust; 38
(iii) A trustee of any indenture of trust under which a bond is 39
issued; or 40

(iv) A trustee under a deed of trust. 1
(21) "Unlawful debt" means any money or other thing of value 2
constituting principal or interest of a debt that is legally 3
unenforceable in the state in full or in part because the debt was 4
incurred or contracted: 5
(a) In violation of any one of the following: 6
(i) Chapter 67.16 RCW relating to horse racing;7
(ii) Chapter 9.46 RCW relating to gambling; 8
(b) In a gambling activity in violation of federal law; or9
(c) In connection with the business of lending money or a thing 10
of value at a rate that is at least twice the permitted rate under 11
the applicable state or federal law relating to usury.12
NEW SECTION. Sec. 7. A new section is added to chapter 9A.56 13
RCW to read as follows: 14
(1) A person is guilty of destruction of critical communications 15
infrastructure if, with intent to cause damage, commit theft, or 16
cause harm to communications infrastructure including both physical 17
and cyber components that deliver voice, video, and data services, he 18
or she causes damage to or renders inoperable such voice, video, or 19
data services. 20
(2) Destruction of critical communications infrastructure is a 21
class C felony. 22
NEW SECTION. Sec. 8. A new section is added to chapter 9A.56 23
RCW to read as follows: 24
(1) In addition to the criminal penalties provided in section 7 25
of this act, there is created a civil cause of action for destruction 26
