AN ACT Relating to authorizing bonds for transportation funding; 1
amending RCW 47.10.879; reenacting and amending RCW 43.84.092, 2
43.84.092, 43.84.092, 43.84.092, 43.84.092, and 43.84.092; adding a 3
new section to chapter 46.68 RCW; adding new sections to chapter 4
47.10 RCW; creating a new section; providing effective dates; 5
providing a contingent effective date; providing expiration dates; 6
providing contingent expiration dates; and declaring an emergency.7
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:8
NEW SECTION. Sec. 1. The legislature finds that it is necessary 9
to provide a stable and dedicated source of funding for the 10
preservation of the state's roads and transportation infrastructure 11
to ensure the continued safety, functionality, and reliability of the 12
transportation system.13
The legislature intends that the proceeds of the sale of bonds in 14
this act be used exclusively for the preservation of existing 15
transportation facilities, including activities necessary to protect 16
the state's investment in highway assets, extend the useful life of 17
transportation structures, and maintain mobility for people and goods 18
throughout the state of Washington. 19

NEW SECTION. Sec. 2. In order to provide funds necessary for 1
the location, design, right-of-way, and construction of highway 2
preservation projects or improvements and ferry vessel construction, 3
there shall be issued and sold upon the request of the department of 4
transportation a total of $3,400,000,000 of general obligation bonds 5
of the state of Washington.6
NEW SECTION. Sec. 3. Upon the request of the department of 7
transportation, as appropriate, the state finance committee shall 8
supervise and provide for the issuance, sale, and retirement of the 9
bonds in this act in accordance with chapter 39.42 RCW. Bonds 10
authorized by this act shall be sold in the manner, at time or times, 11
in amounts, and at the price as the state finance committee shall 12
determine. No bonds may be offered for sale without prior legislative 13
appropriation of the net proceeds of the sale of the bonds.14
The state finance committee shall consider the issuance of short-15
term obligations in lieu of long-term obligations for the purposes of 16
more favorable interest rates, lower total interest costs, and 17
increased marketability and for the purpose of retiring the bonds 18
during the life of the project for which they were issued.19
NEW SECTION. Sec. 4. The proceeds from the sale of bonds 20
authorized by section 2 of this act shall be deposited in the 21
preserve Washington account created in section 10 of this act. The 22
proceeds shall be available only for the purposes enumerated in 23
section 2 of this act, for the payment of bond anticipation notes, if 24
any, and for the payment of bond issuance costs, including the costs 25
of underwriting.26
NEW SECTION. Sec. 5. Bonds issued under the authority of this 27
section and sections 2 through 4, 6, and 7 of this act shall 28
distinctly state that they are a general obligation of the state of 29
Washington, shall pledge the full faith and credit of the state to 30
the payment of the principal thereof and the interest thereon, and 31
shall contain an unconditional promise to pay such principal and 32
interest as the same shall become due. The principal and interest on 33
the bonds shall be first payable in the manner provided in this 34
section and sections 2 through 4, 6, and 7 of this act from the 35
proceeds of the state excise taxes on fuel imposed by chapter 82.38 36
RCW and vehicle-related fees imposed under Title 46 RCW that 37

constitute license fees for motor vehicles required to be used for 1
highway purposes. Proceeds of these excise taxes and vehicle-related 2
fees are hereby pledged to the payment of any bonds and the interest 3
thereon issued under the authority of this section and sections 2 4
through 4, 6, and 7 of this act, and the legislature agrees to 5
continue to impose these excise taxes on fuel and vehicle-related 6
fees in amounts from such sources sufficient to pay, when due, the 7
principal and interest on all bonds issued under the authority of 8
this section and sections 2 through 4, 6, and 7 of this act.9
NEW SECTION. Sec. 6. (1) Both principal and interest on the 10
bonds issued for the purposes of this section and sections 2 through 11
5 and 7 of this act shall be payable from the highway bond retirement 12
fund. The state finance committee may provide that a special account 13
be created in the fund to facilitate payment of the principal and 14
interest. The state finance committee shall, on or before June 30th 15
of each year, certify to the state treasurer the amount required for 16
principal and interest on the bonds in accordance with the bond 17
proceedings. The state treasurer shall withdraw revenues from the 18
motor vehicle fund and deposit in the highway bond retirement fund, 19
or a special account in the fund, such amounts, and at such times, as 20
are required by the bond proceedings.21
(2)(a) Any funds required for bond retirement or interest on the 22
bonds authorized by this section and sections 2 through 5 and 7 of 23
this act shall be taken from that portion of the motor vehicle fund 24
that results from the imposition of excise taxes on fuel and vehicle-25
related fees. 26
(b) Funds required shall never constitute a charge against any 27
other allocations of fuel tax and vehicle-related fee revenues to the 28
state, counties, cities, and towns unless the amount arising from 29
excise taxes on fuel and vehicle-related fees distributed to the 30
motor vehicle fund described in (a) of this subsection proves 31
insufficient to meet the requirements for bond retirement or interest 32
on any such bonds. 33
(c) Any payments for bond retirement or interest on the bonds 34
taken from other revenues from the fuel taxes and vehicle-related 35
fees that are distributable to the state, counties, cities, and towns 36
shall be repaid from the first revenues from the fuel taxes and 37
vehicle-related fees distributed to the motor vehicle fund described 38

in (a) of this subsection not required for bond retirement or 1
interest on the bonds. 2
NEW SECTION. Sec. 7. Bonds issued under the authority of this 3
section and sections 2 through 6 of this act and any other general 4
obligation bonds of the state of Washington that have been or that 5
may be authorized and that pledge fuel excise taxes and vehicle-6
related fees for the payment of principal and interest thereon shall 7
be an equal charge against the revenues from such fuel excise taxes 8
and vehicle-related fees.9
NEW SECTION. Sec. 8. For purposes of sections 2 through 7 of 10
this act, "vehicle-related fees" means vehicle-related fees imposed 11
under Title 46 RCW that constitute license fees for motor vehicles 12
required to be used for highway purposes.13
Sec. 9. RCW 47.10.879 and 2009 c 498 s 8 are each amended to 14
read as follows: 15
In order to provide funds necessary for the location, design, 16
right-of-way, and construction of the state route number 520 corridor 17
projects, as allowed in section 2, chapter 472, Laws of 2009, there 18
shall be issued and sold upon the request of the department of 19
transportation a total of ((one billion nine hundred fifty million 20
dollars)) $2,450,000,000 of general obligation bonds of the state of 21
Washington first payable from toll revenue and excise taxes on motor 22
vehicle and special fuels in accordance with RCW 47.10.883.23
NEW SECTION. Sec. 10. A new section is added to chapter 46.68 24
RCW to read as follows: 25
The preserve Washington account is created in the motor vehicle 26
fund. Moneys in the account may be spent only after appropriation. 27
Expenditures from the account must be used only for the purposes 28
identified in section 1 of this act. 29
Sec. 11. RCW 43.84.092 and 2025 c 417 s 802, 2025 c 399 s 15, 30
2025 c 359 s 12, and 2025 c 299 s 21 are each reenacted and amended 31
to read as follows: 32
(1) All earnings of investments of surplus balances in the state 33
treasury shall be deposited to the treasury income account, which 34
account is hereby established in the state treasury.35

(2) The treasury income account shall be utilized to pay or 1
receive funds associated with federal programs as required by the 2
federal cash management improvement act of 1990. The treasury income 3
account is subject in all respects to chapter 43.88 RCW, but no 4
appropriation is required for refunds or allocations of interest 5
earnings required by the cash management improvement act. Refunds of 6
interest to the federal treasury required under the cash management 7
improvement act fall under RCW 43.88.180 and shall not require 8
appropriation. The office of financial management shall determine the 9
amounts due to or from the federal government pursuant to the cash 10
management improvement act. The office of financial management may 11
direct transfers of funds between accounts as deemed necessary to 12
implement the provisions of the cash management improvement act, and 13
this subsection. Refunds or allocations shall occur prior to the 14
distributions of earnings set forth in subsection (4) of this 15
section. 16
(3) Except for the provisions of RCW 43.84.160, the treasury 17
income account may be utilized for the payment of purchased banking 18
services on behalf of treasury funds including, but not limited to, 19
depository, safekeeping, and disbursement functions for the state 20
treasury and affected state agencies. The treasury income account is 21
subject in all respects to chapter 43.88 RCW, but no appropriation is 22
required for payments to financial institutions. Payments shall occur 23
prior to distribution of earnings set forth in subsection (4) of this 24
section. 25
(4) Monthly, the state treasurer shall distribute the earnings 26
credited to the treasury income account. The state treasurer shall 27
credit the general fund with all the earnings credited to the 28
treasury income account except: 29
(a) The following accounts and funds shall receive their 30
proportionate share of earnings based upon each account's and fund's 31
average daily balance for the period: The abandoned recreational 32
vehicle disposal account, the aeronautics account, the Alaskan Way 33
viaduct replacement project account, the ambulance transport fund, 34
the budget stabilization account, the capital vessel replacement 35
account, the capitol building construction account, the Central 36
Washington University capital projects account, the charitable, 37
educational, penal and reformatory institutions account, the Chehalis 38
basin account, the Chehalis basin taxable account, the clean fuels 39

plan implementation taxable bond account. Earnings derived from 17
investing balances of the agricultural permanent fund, the normal 18
school permanent fund, the permanent common school fund, the 19
scientific permanent fund, and the state university permanent fund 20
shall be allocated to their respective beneficiary accounts.21
(b) Any state agency that has independent authority over accounts 22
or funds not statutorily required to be held in the state treasury 23
that deposits funds into a fund or account in the state treasury 24
pursuant to an agreement with the office of the state treasurer shall 25
receive its proportionate share of earnings based upon each account's 26
or fund's average daily balance for the period. 27
(5) In conformance with Article II, section 37 of the state 28
Constitution, no treasury accounts or funds shall be allocated 29
earnings without the specific affirmative directive of this section.30

shall be allocated to their respective beneficiary accounts.14
(b) Any state agency that has independent authority over accounts 15
or funds not statutorily required to be held in the state treasury 16
that deposits funds into a fund or account in the state treasury 17
pursuant to an agreement with the office of the state treasurer shall 18
receive its proportionate share of earnings based upon each account's 19
or fund's average daily balance for the period. 20
(5) In conformance with Article II, section 37 of the state 21
Constitution, no treasury accounts or funds shall be allocated 22
earnings without the specific affirmative directive of this section.23
Sec. 14. RCW 43.84.092 and 2025 c 417 s 803, 2025 c 399 s 16, 24
and 2025 c 299 s 22 are each reenacted and amended to read as 25

plan implementation taxable bond account. Earnings derived from 1
investing balances of the agricultural permanent fund, the normal 2
school permanent fund, the permanent common school fund, the 3
scientific permanent fund, and the state university permanent fund 4
shall be allocated to their respective beneficiary accounts.5
(b) Any state agency that has independent authority over accounts 6
or funds not statutorily required to be held in the state treasury 7
that deposits funds into a fund or account in the state treasury 8
pursuant to an agreement with the office of the state treasurer shall 9
receive its proportionate share of earnings based upon each account's 10
or fund's average daily balance for the period. 11
(5) In conformance with Article II, section 37 of the state 12
Constitution, no treasury accounts or funds shall be allocated 13
earnings without the specific affirmative directive of this section.14
NEW SECTION. Sec. 17. Sections 2 through 8 of this act are each 15
added to chapter 47.10 RCW.16
NEW SECTION. Sec. 18. (1) Section 11 of this act expires the 17
earlier of July 1, 2028, or when RCW 74.76.040 expires.18
(2) Section 12 of this act expires July 1, 2028.19
(3) Section 13 of this act expires the earlier of January 1, 20
2029, or when RCW 74.76.040 expires. 21
(4) Section 14 of this act expires January 1, 2029.22
(5) Section 15 of this act expires when RCW 74.76.040 expires.23
NEW SECTION. Sec. 19. (1) Section 12 of this act takes effect 24
when RCW 74.76.040 expires.25
(2) Sections 13 and 14 of this act take effect July 1, 2028.26
(3) Sections 15 and 16 of this act take effect January 1, 2029.27
NEW SECTION. Sec. 20. This act is necessary for the immediate 28
preservation of the public peace, health, or safety, or support of 29
the state government and its existing public institutions, and takes 30
effect immediately.31
