AN ACT Relating to modernizing the definition of motor fuel in 1
the motor fuel quality act; and amending RCW 19.112.010.2
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:3
Sec. 1. RCW 19.112.010 and 2009 c 132 s 1 are each amended to 4
read as follows: 5
The definitions in this section apply throughout this chapter 6
unless the context clearly requires otherwise. 7
(1) "Alcohol fuel" means any alcohol made from a product other 8
than petroleum or natural gas that is used alone or in combination 9
with gasoline or other petroleum products for use as a fuel in self-10
propelled motor vehicles. 11
(2) (("Alternative fuel" means all products or energy sources 12
used to propel motor vehicles, other than conventional gasoline, 13
diesel, or reformulated gasoline. Alternative fuel includes, but is 14
not limited to, liquefied petroleum gas, liquefied natural gas, 15
compressed natural gas, biodiesel fuel, E85 motor fuel, fuels 16
containing seventy percent or more by volume of alcohol fuel, fuels 17
that are derived from biomass, hydrogen fuel, anhydrous ammonia fuel, 18
nonhazardous motor fuel, or electricity, excluding onboard electric 19
generation.20

(3))) "Biodiesel fuel" means the monoalkyl esters of long chain 1
fatty acids derived from plant or animal matter that meet the 2
registration requirements for fuels and fuel additives established by 3
the federal environmental protection agency and standards established 4
by the American society of testing and materials. 5
(((4))) (3) "Diesel" means special fuel as defined in RCW 6
82.38.020, and diesel fuel dyed in accordance with the regulations in 7
26 C.F.R. Sec. 48.4082-1T as of October 24, 2005. 8
(((5))) (4) "Director" means the director of agriculture.9
(((6))) (5) "E85 motor fuel" means an alternative fuel that is a 10
blend of ethanol and hydrocarbon of which the ethanol portion is 11
nominally ((seventy-five)) 75 to ((eighty-five)) 85 percent denatured 12
fuel ethanol by volume that complies with the most recent version of 13
American society of testing and materials specification D 5798.14
(((7))) (6) "Motor fuel" means any liquid or gaseous product and 15
electricity used for the ((generation of power in an internal 16
combustion engine used for the )) propulsion of a motor vehicle upon 17
the highways of this state or that is intended for use for 18
transportation purposes , and any biodiesel fuel. Motor fuels 19
containing ethanol may be marketed if either (a) the base motor fuel 20
meets the applicable standards before the addition of the ethanol or 21
(b) the resultant blend meets the applicable standards after the 22
addition of the ethanol. 23
(((8))) (7) "Nonhazardous motor fuel" means any fuel of a type 24
distributed for use in self-propelled motor vehicles that does not 25
contain a hazardous liquid as defined in RCW 19.122.020.26
(((9))) (8) "Renewable diesel" means a diesel fuel substitute 27
produced from nonpetroleum renewable sources, including vegetable 28
oils and animal fats, that meets the registration requirements for 29
fuels and fuel additives established by the federal environmental 30
protection agency in 40 C.F.R. Part 79 (2008) and meets the 31
requirements of American society of testing and materials 32
specification D 975. 33
