Red = new code to be enacted WEST virginia legislature 2026 regular session Enrolled Committee Substitute for Senate Bill 309 By Senator Rucker [Passed February 20, 2026; in effect from passage] AN ACT to amend and reenact §64-8-1 et seq. of the Code of West Virginia, 1931, as amended, relating to authorizing certain agencies of the Department of Transportation to promulgate legislative rules; authorizing the rules as filed and as modified by the Legislative Rule-Making Review Committee; authorizing the Division of Motor Vehicles to promulgate a legislative rule relating to motor vehicle equipment; authorizing the Division of Motor Vehicles to promulgate a legislative rule relating to compulsory motor vehicle liability insurance; and authorizing the Division of Motor Vehicles to promulgate a legislative rule relating to special purpose vehicles. Be it enacted by the Legislature of West Virginia: ARTICLE 8. Authorization for Department of transportation to promulgate legislative rules. §64-8-1. Division of Motor Vehicles. The legislative rule filed in the State Register on July 24, 2025, authorized under the authority of §17A-2-9 of this code, relating to the Division of Motor Vehicles (motor vehicle equipment, 91 CSR 11 ), is authorized. The legislative rule filed in the State Register on July 24, 2025, authorized under the authority of §17A-2A-8 of this code, modified by the Division of Motor Vehicles to meet the objections of the Legislative Rule-Making Review Committee and refiled in the State Register on September 22, 2025, relating to the Division of Motor Vehicles (compulsory motor vehicle liability insurance, 91 CSR 13 ), is authorized. The legislative rule filed in the State Register on June 23, 2025, authorized under the authority of §17A-13-1 of this code, relating to the Division of Motor Vehicles (special purpose vehicles, 91 CSR 25 ), is authorized.
