An Act

relating to:
expanding the Wisconsin deflection initiative and making

an appropriation.
Analysis by the Legislative Reference Bureau
This bill requires the Department of Justice to expand the Wisconsin deflection initiative during the 2025-27 fiscal biennium. The Wisconsin deflection initiative is a program that focuses on identifying, treating, and supporting individuals affected by substance use in a way that limits criminal justice system exposure.
Under the bill, DOJ must expand the Wisconsin deflection initiative by providing grants to current deflection initiative sites for any of the following purposes: to hire additional employees to provide deflection care coordination, to contract with outside vendors for consultations and program evaluations, to acquire deflection care technology, or to contract with an outside vendor to provide deflection care coordination technology.
The bill provides $507,100 in each fiscal year of the 2025-27 biennium and increases the authorized FTE employees for DOJ by 1.0 GPR position for the purpose of expanding the Wisconsin deflection initiative.

. Nonstatutory provisions.

Wisconsin deflection initiative expansion.
During the 2025-27 fiscal

biennium, the department of justice shall implement a pilot program to expand the
4
Wisconsin deflection initiative by providing grants to Wisconsin deflection
5
initiative sites that are active participants in the Wisconsin deflection initiative on
6
the effective date of this subsection. Grants may be awarded under this subsection
7
for any of the following purposes:

To hire additional employees to provide deflection care coordination.

To contract with outside vendors for consultations and program

evaluations.

coordination technology. To obtain a contract under this paragraph, a vendor shall

meet all of the following qualifications:

. The vendor shall have a fully developed system for deflection care

coordination at the time the contract is executed.

. The vendor shall have a minimum of 5 years of experience supporting

multisite deflection initiatives that are comparable to the Wisconsin deflection

. The vendor shall be able to provide a deflection care coordination system

that meets all legal requirements and standards, including privacy protections, the
22
federal Health Insurance Portability and Accountability Act, and

security requirements, and compliance with other applicable laws and best

. A Wisconsin deflection initiative site shall give preference under subd.

a vendor that is recommended by a current Wisconsin deflection initiative site, that

has functionality and flexibility with application programming interfaces, and

whose technology can be customized to reflect the specific resources available to the

site, including the ability to securely collect referrals from supporting organizations
8
or individuals.

Notwithstanding

s. 16.42 (1) (e), in submitting information under s. 16.42 for the 2027-29 biennial

budget bill, the department of justice shall submit information concerning the

appropriation under s. 20.455 (1) (a) as though the increase in the dollar amount of
13
that appropriation by
