An Act

to create
19.45 (8m) of the statutes;
relating to:
prohibited

employment for former members of the Public Service Commission.
Analysis by the Legislative Reference Bureau
Under this bill, no former commissioner of the Public Service Commission, for 36 months following the date on which he or she ceases to be a commissioner, may engage in employment for compensation with an investor-owned public utility or a transmission company if the former commissioner’s employment duties for the utility or company include policy making or executive decision-making, operations management, or government relations. Any violation of the bill’s employment prohibition is enforced as a violation of the state’s code of ethics for state public officials under laws administered by the Ethics Commission. Additionally, the bill’s employment prohibition first applies retroactively to a person who ceases to be a commissioner during the 12 months immediately preceding the date on which the bill becomes law.
The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

(a) In this subsection:

1. “Commissioner” means a commissioner of the public service commission.

2. “Public utility” has the meaning given in s. 196.01 (5).

3. “Transmission company” has the meaning given in s. 196.485 (1) (ge).

(b) No former commissioner, for 36 months following the date on which he or

she ceases to be a commissioner, may engage in employment for compensation with

an investor-owned public utility or a transmission company if the former
7
commissioner’s employment duties for the public utility or transmission company
8
include policy making or executive decision-making, operations management, or
9
government relations.
