An Act

relating to:
a study committee on the installation of empty conduit

lines for future fiber-optic internet expansion.
Analysis by the Legislative Reference Bureau
This bill creates a Legislative Council study committee to study and recommend to the legislature legislative strategies relating to requiring the installation of empty conduit lines for future fiber-optic internet expansion, commonly known as a “Dig Once Law.” The bill requires that the committee focus on details necessary to implement such a law, such as issues relating to communication among relevant entities and ownership of and responsibility over the conduit lines.
The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

. Nonstatutory provisions.

Legislative council study committee.

There is established a legislative council study committee to study and

recommend to the legislature legislative strategies relating to requiring the

installation of empty conduit lines for future fiber-optic internet expansion,

commonly known as a “Dig Once Law.” Specifically, the committee shall focus on

details necessary to implement such a law, including all of the following:

. Required communication between a municipality, a construction company

or engineering firm, and the future internet service provider.

. Determination of ownership of the empty conduit infrastructure.

. Responsibility for maintenance costs for empty conduit lines and for

conduit lines that are in use by one or more internet service providers.

. Whether a municipality may require larger conduit lines for use by

multiple internet service providers.

. The most effective time to install an empty conduit line, whether during

road construction, utility construction, initial internet service provider line

installation, or another time.

. Any other details the committee determines are necessary for

implementation of the law.

The committee shall consist of members as determined by the joint

legislative council. The committee shall submit its recommendations no later than
18
January 1, 2027, to the chief clerk of each house of the legislature for distribution to

the legislature under section 13.172 (2) of the statutes.
