An Act
to amend
29.192 (4) (a), 29.563 (14) (a) 1. and 29.563 (14) (a) 3.;
to

create
20.370 (1) (hy) and 29.192 (7) of the statutes;
relating to:
sharp-tailed

grouse hunting permits and making an appropriation.
Analysis by the Legislative Reference Bureau
Under current law, the Department of Natural Resources issues permits for the hunting of sharp-tailed grouse. If the number of persons seeking the permits exceeds the number of available permits, DNR must issue the permits according to a cumulative preference system, under which DNR prioritizes issuance of permits to applicants with more preference points.
Under the current cumulative preference system, for each hunting season, DNR must give a preference point to each applicant who applies for a permit but who is not selected. An applicant who fails to apply for a permit at least once during any three consecutive years loses all previously accumulated preference points. The bill eliminates the cumulative preference system, five years after the bill is enacted, and replaces it with a lottery to determine who will be issued permits.
Under current law, the processing fee for a sharp-tailed grouse hunting permit is $2.75. This bill increases the fee to $9.75 and credits $7 of the fee to an appropriation to be used for administering sharp-tailed grouse hunting permits and for sharp-tailed grouse management and research activities.

(a) If the department decides to limit the number of persons taking

Canada geese
or sharp-tailed grouse
by issuing permits and if the number of
9
persons seeking the permits exceeds the number of available permits, the
10
department shall issue the permits according to a cumulative preference system
11
established by the department. The department shall give a preference point to
12
each applicant for each previous season for which the applicant applied but was not
13
issued a permit. The system shall establish preference categories for these
14
applicants, with higher priority given to those categories with more points than
15
those with fewer points. Applicants who fail to apply at least once during any 3
16
consecutive years shall lose all previously accumulated preference points. If the
17
number of applicants within a preference category or subcategory exceeds the
18
number of permits available in the category or subcategory, the department shall
19
select at random within the category or subcategory the applicants to be issued the
20
permits.

(a) Except as provided in par. (b), if the department issues sharp-

tailed grouse hunting permits, the department shall issue a resident or nonresident
4
sharp-tailed grouse hunting permit to any person who applies for such a permit and
5
who pays the fees required for the permit.

(b) In issuing resident sharp-tailed grouse hunting permits and nonresident
7
sharp-tailed grouse hunting permits under this subsection, the department shall
8
determine the number of permits it will issue in a given sharp-tailed grouse
9
hunting season and shall allocate the permits to residents and nonresidents in the
10
following manner:

1. If the number of applicants for resident sharp-tailed grouse hunting
12
permits exceeds the number of resident sharp-tailed grouse hunting permits that
13
are available, the department shall select at random the residents to be issued the
14
permits. If the number of applicants for resident sharp-tailed grouse hunting
15
permits is less than the number of resident sharp-tailed grouse hunting permits
16
that are available, the department shall reallocate the unissued permits to be
17
issued as nonresident sharp-tailed grouse hunting permits under subd. 2.

2. If the number of applicants for nonresident sharp-tailed grouse hunting

permits exceeds the number of nonresident sharp-tailed grouse hunting permits
20
that are available, the department shall select at random the nonresidents to be
21
issued the permits. If the number of applicants for nonresident sharp-tailed grouse

hunting permits is less than the number of nonresident sharp-tailed grouse
23
hunting permits that are available, the department shall reallocate the unissued
24
permits to be issued as resident sharp-tailed grouse hunting permits.
