An Act
to amend
252.04 (1), 609.88 (title), 632.895 (14) (title) and 632.895 (14)

(b);
to create
609.883 and 632.895 (14c) of the statutes;
relating to:
health

insurance coverage of vaccines if recommended by certain organizations and
4
consideration of recommendations of certain organizations regarding the state
5
immunization program vaccination schedule.
Analysis by the Legislative Reference Bureau
This bill applies to health insurance policies and self-insured governmental plans that provide coverage for vaccines recommended by the U.S. Centers for Disease Control and Prevention. Under the bill, if the federal government withdraws the recommendations for a vaccine, the policies and plans must continue to provide coverage for the vaccine, on an equal basis, if the vaccine is recommended by the American Academy of Pediatrics or American Academy of Family Physicians. The bill also requires the Department of Health Services, in considering diseases for elimination to be included in the vaccination schedule for the state’s immunization program, to take into account the recommendations of the American Academy of Pediatrics or American Academy of Family Physicians.
This proposal may contain a health insurance mandate requiring a social and financial impact report under s. 601.423, stats.
The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

The department shall carry out a statewide immunization program

to eliminate mumps, measles, rubella (German measles), diphtheria, pertussis
4
(whooping cough), poliomyelitis and other diseases that the department specifies by
5
rule, and to protect against tetanus.
The department shall, in considering diseases
6
for elimination to be included in the vaccination schedule as provided under this
7
section, take into account the recommendations, if any, of the American Academy of
8
Pediatrics or American Academy of Family Physicians.
Any person who immunizes
9
an individual under this section shall maintain records identifying the
10
manufacturer and lot number of the vaccine used, the date of immunization and the
11
name and title of the person who immunized the individual. These records shall be
12
available to the individual or, if the individual is a minor, to his or her parent,
13
guardian or legal custodian upon request.
