An Act

to create
100.20 (1p) and 100.306 of the statutes;
relating to:
unfair

sales practices at publicly funded stadiums.
Analysis by the Legislative Reference Bureau
This bill prohibits a stadium owner, operator, or concessionaire from selling or offering for sale within the stadium food or beverages at a price that exceeds the seller’s cost of the food or beverages plus a markup of no more than 20 percent. The seller’s cost is calculated as provided in the state’s unfair sales act, commonly known as the minimum markup law. The bill defines “stadium” as a multipurpose facility that is designed and principally used for sporting or entertainment events; that has a capacity of at least 3,000 persons; and the owner of which receives direct or indirect financial assistance from the state or a local governmental unit, including payments, grants, and tax incentives. A “stadium” does not include a facility owned or leased by a primary or secondary school. A violation of the bill’s provisions is an unfair trade practice enforceable by the Department of Agriculture, Trade and Consumer Protection.
The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

Definitions.
In this section:

(a) “Concessionaire” means a person authorized by the owner or operator of a

stadium to sell food or beverages at designated locations within the stadium.

(b) “Public financial support” means any form of direct or indirect financial

assistance from the state or a local governmental unit, as defined in s. 16.97 (7),
10
including payments; grants; loans; tax reductions, incentives, or benefits; or
11
proceeds from tax-exempt bonds.

(c) 1. Except as provided in subd. 2., “stadium” means a multipurpose facility

that meets all of the following criteria:

a. The facility is located in this state.

b. The facility is designed and principally used for sporting or entertainment

events or both.

Prohibition.
A stadium owner, operator, or concessionaire may not sell or

offer for sale within the stadium food or beverages at a price that exceeds the cost to
4
retailer, as calculated under s. 100.30 (2) (am) 2. and (b), for the food and beverages,

plus a markup of no more than 20 percent.
