An Act
to create
20.490 (7), 234.47 and 710.15 (5w) of the statutes;
relating

to:
penalties imposed on owners of mobile or manufactured home
3
communities, grants for mobile homes and manufactured homes, and making
4
an appropriation.
Analysis by the Legislative Reference Bureau
Under this bill, the Department of Safety and Professional Services may impose a $5,000 forfeiture on the owner of a mobile or manufactured home community for each year in which the owner violates any requirement under current law regarding the regulation of such communities, including reporting requirements. Under the bill, any unpaid forfeiture, assessment, or fee owed by the community owner creates a lien on the community property that continues until released and discharged by DSPS.
Under the bill, the revenue received from the forfeitures is credited to the Wisconsin Housing and Economic Development Authority to provide grants to mobile or manufactured home community owners for the purpose of bringing the communities into compliance with licensing standards and owners of mobile homes or manufactured homes for the purpose of repairing, renovating, and improving such homes.

Definitions.

(a) “Manufactured home” has the meaning given in s. 101.91 (2).

(b) “Mobile home” has the meaning given in s. 101.91 (10), but does not

include a recreational vehicle, as defined in s. 340.01 (48r).

(c) “Mobile or manufactured home community” has the meaning given for

“community” in s. 710.15 (1) (ad).

Grants
. (a) The authority may provide grants to owners of mobile or

manufactured home communities for the purpose of bringing the mobile or
16
manufactured home communities into compliance with licensing standards. The
17
authority may also provide grants to owners of mobile homes or manufactured
18
homes for the purpose of repairing, renovating, and improving such homes.

Penalties
. (a) Any community owner who violates a

requirement under this section, including a reporting requirement, may be subject
2
to a $5,000 forfeiture for each year, or part thereof, in which the community owner
3
is in violation of a requirement under this section. The department of safety and
4
professional services shall impose and collect the forfeitures under this subsection.

An unpaid forfeiture under this subsection and any unpaid assessments and fees
6
owed by the community owner creates a lien that continues until released and
7
discharged by the department. Forfeitures paid under this subsection shall be
8
credited to the appropriation under s. 20.490 (7) (a) to be used for the purposes
9
under s. 234.47.
