An Act
to create
20.155 (3) (c) and 197.11 of the statutes;
relating to:
grants

to municipalities to acquire or create public utilities and making an

appropriation.
Analysis by the Legislative Reference Bureau
Under current law, a municipality has the power to construct and operate a plant and equipment for the production, transmission, delivery, or furnishing of heat, light, water, or power; to purchase any public utility on terms approved by the Public Service Commission; and to acquire the property of any public utility. “Municipality” is defined to mean any town, village, or city wherein property of a public utility or any part thereof is located. This bill creates a grant program under which PSC must award a grant to any municipality that takes any of the aforementioned actions for the purpose of owning and operating a public utility if the municipality has secured from PSC a certificate of public convenience and necessity to do so. Under the bill, such a grant must cover 50 percent of the costs of construction or acquisition. The bill funds the grant program with a sum sufficient appropriation.

(1)
The commission shall award

a grant as provided under this section to any municipality in this state that, for the
7
purpose of owning and operating a public utility, seeks to construct and operate a
8
plant or equipment under s. 197.01 (1), to purchase a public utility or any part
9
thereof under s. 197.01 (2), or to acquire the property of any public utility under s.
10
197.01 (3) and has secured from the commission a certificate of public convenience
11
and necessity to construct, own, operate, manage, or control any plant or equipment
12
for the production, transmission, delivery, or furnishing of heat, light, water, or
13
power. A municipality may apply to the commission for a grant under this section
14
in a manner and form determined by the commission and shall submit with the
15
application all information requested by the commission.

The commission shall award a grant under this section in the amount of

50 percent of the costs of the construction or acquisition under sub. (1).
