An Act

to create
100.76 of the statutes;
relating to:
requiring retail sellers to

accept cash and providing a penalty.
Analysis by the Legislative Reference Bureau
This bill requires a retailer who sells goods or services from a physical location to accept cash as payment during a face-to-face sale with a consumer at one or more points of sale at the physical location, unless the person is otherwise prohibited by law from accepting cash. A retailer who violates this requirement is subject to a civil forfeiture of $200 to $5,000.
For further information see the state fiscal estimate, which will be printed as an appendix to this bill.
The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

Retail sellers required to accept cash.
A person who sells goods or
5
services at retail from a physical location shall accept cash in exchange for those
6
goods or services during a face-to-face sale with a consumer at one or more points of
1
sale at the physical location, unless the person is otherwise prohibited by law from
2
accepting cash for the goods or services being sold. The department, or any district
3
attorney upon notifying the department, may commence an action in the name of
4
the state to recover a forfeiture to the state of not less than $200 and not more than
5
$5,000 for each violation of this section. In lieu of or in addition to a forfeiture, the
6
department, or any district attorney upon notifying the department, may seek a
7
temporary or permanent injunction restraining any person from violating this
8
section.
