An Act
to create
16.24 of the statutes;
relating to:
withholding state
2
payments to the federal government if federal aid to the state is withheld
3
under certain circumstances.
Analysis by the Legislative Reference Bureau
Under this bill, if the secretary of administration determines that federal aid to Wisconsin that was previously authorized under an act of Congress is being withheld under an executive order of the president of the United States or in contravention of a court order, the secretary must do all of the following:
1. Determine the approximate amount of federal aid the state is being or is expected to be deprived of as the result of the executive order or contravention of the court order.
2. No later than 60 days after the date of the executive order or court order, submit a report to the governor and the legislature that describes in detail the amount of federal aid the state is being or is expected to be deprived of as the result of the executive order or contravention of the court order and identifies all moneys the state must pay to the federal government for any reason during the succeeding 12 months after the report is submitted.
3. Withhold the payment to the federal government of those identified moneys in a total amount not to exceed the approximate amount of federal aid the state is being or is expected to be deprived of.
4. Authorize the payment to the federal government of those withheld moneys upon the state’s receipt of all federal aid previously withheld under the executive order or in contravention of the court order.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

16.24 of the statutes is created to read:

Frozen federal aid; withholding of payments to the federal

government.
If the secretary determines that federal aid to this state that was
4
previously authorized under an act of Congress is being withheld under an
5
executive order of the president of the United States or in contravention of a court
6
order, the secretary shall do all of the following:

Determine the approximate amount of federal aid this state is being or is
8
expected to be deprived of as the result of the executive order or contravention of the
9
court order.

(2)
No later than 60 days after the date of the executive order or court order,

submit to the governor and to the chief clerk of each house of the legislature for
12
distribution to the legislature under s. 13.172 (2) a report that does all of the
13
following:

(a) Describes in detail the amount of federal aid this state is being or is
15
expected to be deprived of as the result of the executive order or contravention of the
16
court order, as determined under sub. (1).

(b) Identifies all moneys this state is required to pay to the federal

government for any reason during the succeeding 12 months after the report is
19
submitted.

Of the moneys identified under sub. (2) (b), withhold the payment of those

moneys to the federal government in a total amount not to exceed the approximate

amount of federal aid this state is being or is expected to be deprived of as the result
4
of the executive order or contravention of the court order, as determined under sub.

Authorize the payment to the federal government of the moneys withheld

under sub. (3) upon the state’s receipt of all federal aid previously withheld under
8
the executive order or in contravention of the court order.
