An Act
to renumber and amend
114.32 (3);
to create
114.32 (3) (c) of the

statutes;
relating to:
certain airport improvement contracts.
Analysis by the Legislative Reference Bureau
This bill specifies that Department of Transportation contracts for improvements to airport facilities that are “qualified projects” may be “construction manager at risk contracts.” Under the bill, qualified projects are projects for the construction or improvement of a structure, and construction manager at risk contracts are contracts in which the construction manager agrees to complete the project within a guaranteed maximum price.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

contracts for the

acquisition, construction, improvement, maintenance

(c) 1. In this paragraph:

a. “Construction manager at risk contract” means a contract in which the

construction manager agrees to complete the project within a guaranteed
19
maximum price.

b. “Qualified project” means a project for the construction or improvement of

a structure, including any paving or sitework necessary for the construction or

improvement of the structure.

2. The secretary of transportation may enter into contracts under par. (a) for

qualified projects and, to the extent authorized by federal authorities, under par. (b)

for qualified projects as construction manager at risk contracts. A construction
2
manager under this paragraph need not be selected solely on the basis of price.
