An Act

to create
97.26 of the statutes;
relating to:
the disclosure of certain

ingredients in food and providing a penalty.
Analysis by the Legislative Reference Bureau
This bill requires a person that manufactures packaged food intended for human consumption for distribution or sale in this state to label the packaged food products with warning labels that disclose the use or existence of any of a list of ingredients in the food product, including certain color additives, synthetic antioxidants, solvents, sweeteners, stabilizers, thickeners, and preservatives. The warning labels must be prominent, in high contrast to their immediate backgrounds, and in a reasonably visible location, and include the statement “WARNING: This product contains an artificial color, chemical, or food additive that is banned in Australia, Canada, the European Union, or the United Kingdom.”
A person that violates a provision of the bill maybe subject to a criminal penalty that may range from $100 to $5,000 or up to one year imprisonment, or both. In lieu of the criminal penalty, a violator may be subject to a civil penalty of not more than $1,000 for each violation.
For further information see the state and local fiscal estimate, which will be printed as an appendix to this bill.
Because this bill creates a new crime or revises a penalty for an existing crime, the Joint Review Committee on Criminal Penalties may be requested to prepare a report.
The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:
