An Act

to create
995.80 of the statutes;
relating to:
prohibiting state agencies

and local governmental units from using facial recognition technology or data

generated from it.

This bill prohibits any state agency or local governmental unit from using facial recognition technology or data generated from it for any purpose. The bill defines “facial recognition technology” as an automated system that takes from camera footage a digital image or video frame of an individual’s face and compares it against a database of faces in order to identify matches.
The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

Use of facial recognition technology.

(1)

Definitions.
In this

(a) “Facial recognition technology” means an automated system that takes

from camera footage a digital image or video frame of an individual’s face and
2
compares it against a database of faces in order to identify matches.

(b) “Local governmental unit” means a political subdivision of this state, a

special purpose district in this state, an agency or corporation of a political
5
subdivision or special purpose district, or a combination or subunit of any of the
6
foregoing.

(c) “State agency” means an association, authority, board, department,

commission, independent agency, institution, office, society, or other body in state
9
government created or authorized to be created by the constitution or any law.

Prohibition.
No state agency or local governmental unit may use facial
11
recognition technology or data generated from facial recognition technology for any
12
purpose except for identifying employees of the state agency or local governmental
13
unit for purposes related to employment.
