An Act
to amend
66.0511 (title);
to create
66.0511 (6) of the statutes;

relating to:
prohibiting a law enforcement agency from accessing personal

data in exchange for payment without a warrant.
Analysis by the Legislative Reference Bureau
Under current law, no law enforcement officer may identify or track the location of an individual’s communication device, such as a phone or another device that transmits communications, unless the law enforcement officer has a warrant or an exception applies such as for exigent circumstances or with consent of the owner.
This bill prohibits a law enforcement agency from requesting, obtaining, or receiving access to any individual’s personal data in exchange for payment or a thing of value without a warrant. The bill creates the same exceptions to the prohibition for exigent circumstances or with consent of the owner. The bill defines “personal data” as information collected from or generated by an individual as part of a consumer transaction or as part of the use of a product or service, including billing information, demographic data, Internet search history, or use of applications.
The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

Prohibition on use of purchased personal data.
(a) In this

subsection, “personal data” means information collected from or generated by an
7
individual as part of a consumer transaction or as part of the use of a consumer
8
product or service that can be linked to the individual. “Personal data” includes an
9
individual’s name, billing information, social security number, address, or
10
demographic data; an individual’s Internet search history or browsing or use of
11
applications; an individual’s actual or approximate location or location of a device
12
owned or operated by the individual; an individual’s financial information, health
13
information, biometric information, or characteristics of classifications protected
14
under law; identifiers of devices; and content of communications by an individual.

(b) Except as provided under par. (c), no law enforcement officer may do any of
16
the following:

1. Request, obtain, or receive access to any individual’s personal data from a
18
3rd party in exchange for payment or a thing of value.

2. Request, obtain, or receive access to any individual’s personal data from a
20
governmental entity if the law enforcement officer knows or should know that the
21
governmental entity obtained or received it in exchange for payment or a thing of
22
value.

(c) Paragraph (b) does not apply if any of the following applies:

1. The law enforcement officer has obtained a warrant under ch. 968 to obtain

or receive access to the personal data of a specified individual.

2. An emergency involving danger of death or serious physical injury to any
4
individual exists and accessing the personal data is relevant to preventing the
5
death or injury or to mitigating the injury.

3. The personal data is available to the public through governmental records

or media.

4. The individual to whom the personal data is linked expressly consented to
9
the law enforcement officer’s access to the specific personal data.
