An Act

to create
98.09 of the statutes;
relating to:
displaying gas taxes on gas

pumps.
Analysis by the Legislative Reference Bureau
This bill requires a state or municipal weights and measures inspector or sealer, when inspecting a gas pump, to place a sticker on the pump that shows the federal and state gas tax rates per gallon of gas. The bill requires the Department of Agriculture, Trade and Consumer Protection to develop a sticker for this purpose and to distribute stickers to all state and municipal weights and measures inspectors and sealers who inspect gas pumps. DATCP is also required to update and redistribute the stickers when the federal or state gas tax rate changes.
For further information see the state and local fiscal estimate, which will be printed as an appendix to this bill.
The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

Motor vehicle fuel pump sticker.

(1)
The department shall produce

a sticker, for display on each motor vehicle fuel pump from which motor vehicle fuel
1
is dispensed for sale at retail in this state, that shows the federal motor vehicle fuel
2
tax rate and the state motor vehicle fuel tax rate, in cents per gallon, for gasoline
3
and for diesel fuel. The sticker shall be at least 3.5 inches on each side. The
4
department shall distribute the sticker to all inspectors and sealers who inspect or
5
seal motor vehicle fuel pumps in this state. The department shall produce and
6
distribute a new sticker each time the federal or state motor vehicle fuel tax rate
7
changes.

(2)
Inspectors and sealers who inspect or seal motor vehicle fuel pumps shall,
9
at the time of inspecting or sealing a motor vehicle fuel pump, place the sticker
10
produced under sub. (1) on the pump being inspected or sealed. Inspectors and
11
sealers shall display the sticker on the face of the pump so that it is clear,
12
conspicuous, and prominent to consumers.

An owner or operator of a motor vehicle fuel pump from which motor

vehicle fuel is dispensed for sale at retail is not liable for affixing or maintaining a
15
sticker under this section.
