An Act
to create
20.395 (4) (be) and 343.179 of the statutes;
relating to:

creating a blue envelope program, granting rule-making authority, and
3
making an appropriation.
Analysis by the Legislative Reference Bureau
This bill requires the Department of Transportation to establish and administer a blue envelope program to promote inclusivity and enhanced communication between law enforcement officers and individuals with a condition or disability for which additional accommodations or awareness may be necessary.
Under the bill, DOT must develop and produce a blue envelope designed to hold a copy of the recipient’s vehicle registration, insurance card, and other useful documents. In addition, the blue envelope must contain all of the following: 1) printed information for the recipient regarding traffic stop safety, 2) printed recommendations for responding law enforcement officers regarding interaction techniques to promote enhanced communication and accommodation between law enforcement officers and the recipient, 3) a space for the recipient to provide emergency contact information, and 4) a space for the recipient or their emergency contact to add additional information pertaining to the recipient’s needs or requested accommodations.
Under the bill, an individual may obtain a blue envelope by declaring, on a form provided by DOT, that they have an invisible disability. DOT must provide a blue envelope to an individual that is any of the following: 1) an individual protected by the federal Americans with Disabilities Act; 2) an individual who has a condition or disability for which additional accommodations or awareness may be necessary; or 3) a parent or legal guardian, family member, conservator, or driver of an individual with a disability. For each individual to whom
DOT issues a blue envelope, DOT must record the issuance in its file for the individual.
The bill requires DOT to promulgate rules for the administration of the blue envelope program, including rules for the development of supplementary training materials for law enforcement.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

An individual may obtain a blue envelope produced under sub. (2) by
