An Act

to create
115.31 (2c) and 885.01 (6) of the statutes;
relating to:
the

state superintendent’s power to issue a subpoena in a license revocation

investigation.
Analysis by the Legislative Reference Bureau
Under current law, the state superintendent of public instruction may revoke a license to teach issued by the state superintendent on the basis of the license holder’s incompetency or immoral conduct. This bill authorizes the state superintendent of public instruction to subpoena witnesses and the production of relevant documents and items to aid in an investigation relating to the revocation of a license for incompetency or immoral conduct.
The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

The state superintendent, or their designee, may issue a

subpoena, in substantially the form authorized under s. 885.02, to compel the

appearance of a witness or the production of a relevant document or item to aid in

an investigation relating to the revocation of a license granted by the state
2
superintendent for incompetency or immoral conduct under sub. (2).
