An Act

to amend
165.845 (1r) (a) 1., 939.632 (1) (e) 1. and 939.632 (1) (e) 3. of

the statutes;
relating to:
fixing a cross-reference in a definition of “violent

crime” and updating terminology to reflect changes in the Federal Bureau of

Investigation (suggested as remedial language by the Department of Justice).
Analysis by the Legislative Reference Bureau
Current law contains a definition of the term “violent crime” for the purposes of the crime of committing a violent crime in a school zone. The definition is parsed into a list of felonies and a list of misdemeanors. Under current law, one crime appears in the incorrect list; it is a felony but is listed as a misdemeanor. This bill moves the errant reference from the list of misdemeanors to the list of felonies.
The Federal Bureau of Investigation collects crime data from law enforcement agencies. The FBI used to use a program called the system of uniform crime reports. Beginning in January 2021, the FBI’s National Incident-Based Reporting System became the national standard. This bill updates terminology to reflect that change.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:
Law Revision Committee prefatory note:
This bill is a remedial legislation proposal, requested by the Department of Justice and introduced by the Law Revision Committee under s. 13.83 (1) (c) 4. and 5., stats. After careful consideration of the various provisions of the bill, the Law Revision Committee has determined that this bill makes minor substantive changes in the statutes, and that these changes are desirable as a matter of public policy.
