An Act
to amend
30.80 (1);
to create
30.50 (2m), 30.52 (5) (c), 30.62 (7) and

30.80 (7) of the statutes;
relating to:
carbon monoxide detection systems on

motorboats and providing a penalty.
Analysis by the Legislative Reference Bureau
This bill prohibits the operation of a motorboat with an enclosed accommodation compartment unless 1) the motorboat is equipped with a marine carbon monoxide detection system and 2) a carbon monoxide warning sticker is affixed to the interior of the enclosed accommodation compartment. The bill also prohibits the sale of a new motorboat unless the motorboat is equipped with a marine carbon monoxide detection system and the carbon monoxide warning sticker. The bill provides for a $300 forfeiture for second and subsequent violations of these requirements.
The bill requires the Department of Natural Resources to provide printed information about the dangers of carbon monoxide and boating to any person who applies for a certificate of number card or a registration card for a motorboat. If the boat is a cabin motorboat, which is a motorboat with enclosed spaces inside its structure, DNR must also provide the person a carbon monoxide warning sticker.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

Carbon monoxide information and sticker.
1. When the

department issues a certificate of number card or a registration card for a
7
motorboat under this subsection, the department shall provide the applicant with
8
printed information on the dangers of carbon monoxide and boating. If the
9
motorboat is a cabin motorboat, the department shall also provide the applicant
10
with a carbon monoxide warning sticker.

2. The department shall provide the printed information and sticker under
12
subd. 1. at no additional cost to an applicant. The department may develop and
13
produce the sticker or may purchase a sticker approved by the U.S. coast guard.

Carbon monoxide detection systems.
(a) In this subsection:

1. “Enclosed accommodation compartment” means a space containing

designated sleeping accommodations, a galley with a sink, and a head
18
compartment.

2. “Marine carbon monoxide detection system” means a device or system for
20
detecting carbon monoxide that is certified by a nationally recognized testing
21
laboratory to conform to current UL Standards for use on motorboats.

(b) No person may operate a motorboat that has an enclosed accommodation

compartment unless all of the following apply:

1. The motorboat is equipped with a functioning marine carbon monoxide
4
detection system to monitor the atmosphere of the main cabin of the enclosed
5
accommodation compartment.

2. Each sleeping accommodation on the motorboat contains, or is located not
7
more than 10 feet from, a functioning marine carbon monoxide detection system.

3. A carbon monoxide warning sticker provided by the department or the
9
original manufacturer of the motorboat is affixed to the interior of the enclosed
10
accommodation compartment in plain view of the motorboat occupants.

(c) No person may sell a new motorboat that has an enclosed accommodation

compartment unless the motorboat is equipped with a marine carbon monoxide
13
detection system as required in par. (b) 1. and 2. and a carbon monoxide warning
14
sticker is affixed as required in par. (b) 3.

Any person violating any provision of ss. 30.50 to 30.80 for which a
