An Act

to create
946.412 of the statutes;
relating to:
dissemination of

personally identifying information of an officer and providing a penalty.
Analysis by the Legislative Reference Bureau
Current law provides penalties for various forms of interference with law enforcement, including resisting or obstructing an officer or escaping from custody. Under this bill, it is a Class H felony to publish, post, or disclose to a public internet site or public forum the personally identifying information of a law enforcement officer, corrections officer, juvenile detention officer, or a federal agent or federal law enforcement officer operating in this state if the action is taken to intimidate, abuse, threaten, harass, or frighten the officer or to obstruct or delay an investigation, an enforcement action, or a duty of the officer.
Because this bill creates a new crime or revises a penalty for an existing crime, the Joint Review Committee on Criminal Penalties may be requested to prepare a report.
The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

In this section:

(a) “Disseminate” means to electronically publish, post, or disclose to a public

internet site or public forum.

(b) “Officer” means a law enforcement officer, as defined in s. 165.85 (2) (c), a
6
tribal law enforcement officer, as defined in s. 165.85 (2) (g), a correctional officer,
7
as defined in s. 301.28 (1), a juvenile detention officer, as defined in s. 165.85 (2)

(bt), or a federal agent or federal law enforcement officer operating in this state.

(c) “Personally identifying information” means information that identifies or

reasonably can be used to identify an individual.

A person who knowingly disseminates the personally identifying

information of an officer is guilty of a Class H felony if any of the following apply:

(a) The dissemination was made with the intent to intimidate, abuse,

threaten, harass, or frighten the officer.

(b) The dissemination was made with the intent to obstruct or delay a

criminal investigation, an enforcement operation, or another duty of the officer.
