An Act
to create
66.0104 (1) (am) and 66.0104 (4) of the statutes;
relating to:

local regulation of landlords and tenants.
Analysis by the Legislative Reference Bureau
Current law prohibits cities, villages, towns, and counties (local governments) from enacting ordinances that impose certain limitations on residential landlords, including 1) restricting a landlord in entering into a rental agreement with a prospective tenant while the premises is occupied by a current tenant; 2) restricting a landlord in showing a premises to a prospective tenant during a current tenant’s tenancy; or 3) requiring a landlord to provide to a tenant information that is not required to be provided under federal or state law.
This bill creates an exception to these restrictions, allowing a local government to enact an ordinance that 1) requires a landlord to make a good faith offer to renew a tenant’s lease unless there is good cause for nonrenewal, and establishes standards for determining good cause; 2) prescribes notice requirements related to a landlord’s offer to renew a lease; 3) establishes requirements related to the execution of a renewed lease agreement; 4) prescribes timeframes during which a landlord may enter a leased premises to show the premises to prospective tenants or lease the premises to another tenant for a subsequent lease period; or 5) provides a penalty or remedy for violation of the ordinance.
The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

Notwithstanding sub. (2) (a) 3. and 4. and (d) 1., after the effective

date of this subsection .... [LRB inserts date], a city, village, town, or county may

enact an ordinance that does any of the following:

(a) Requires a residential landlord to make a good faith offer to renew a
8
tenant’s lease for a successive lease period unless there is good cause for
9
nonrenewal, establishes standards for determining good cause for nonrenewal, and
10
prescribes notice requirements related to an offer to renew a lease, including a
11
prescribed timeframe for the offer and for a tenant’s response.

(b) Establishes requirements related to the execution of a lease agreement

renewing a lease for a successive lease period.

(c) Prescribes a timeframe during which a residential landlord may enter a

leased premises to show the premises to prospective tenants and a timeframe

during which a residential landlord may enter into a lease agreement with another

prospective tenant for a subsequent lease period.

private cause of action or requirement that the residential landlord pay relocation

assistance to the tenant.
