to renumber and amend
59.10 (3) (e);
to repeal and recreate

to create
59.10 (3) (e) 5. of the statutes;
relating to:
filling vacancies

on a county board.
Analysis by the Legislative Reference Bureau
Under current law, in counties other than Milwaukee County, if a vacancy occurs on the county board, the county chairperson, with the approval of the board, appoints a person to fill the vacancy.
Under this bill, upon a vacancy in the county board, the board chairperson must publish a public notice of the vacancy and the procedure for applying for the vacant position. No earlier than 14 days after publishing the notice, the board chairperson, with the approval of the board, must appoint a person who applied for the position. The bill also specifies that a vacancy that occurs after November 30 in the year preceding expiration of the term of office may not be filled by such an appointment.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

A vacancy on the board shall be filled as provided

under s. 59.10 (3) (e).

a vacancy occurs on the

shall publish a class 1 notice, under ch. 985, of the

vacancy. The notice under this subdivision shall provide the procedure by which a

person may apply to be considered for the vacant position.

The board may, if a vacancy occurs before June 1 in the year preceding

expiration of the term of office, order a special election to fill the vacancy. If the

board orders a special election during the period beginning on June 1 and ending on

November 30 of any year, the special election shall be held concurrently with the

succeeding spring election. If the board orders a special election during the period
23
beginning on December 1 and ending on May 31 of the succeeding year, the special
24
election shall be held on the Tuesday after the first Monday in November following
1
the date of the order. A person

under this subdivision
shall serve for the
