An Act
to amend
49.46 (2) (b) 1. (intro.);
to create
49.43 (2x) and 49.46 (2) (bo)

of the statutes;
relating to:
dental services for pregnant persons under the

Medical Assistance program.
Analysis by the Legislative Reference Bureau
Under current law, certain basic dentists’ services provided to Medical Assistance recipients are covered under the Medical Assistance program. This bill provides Medical Assistance coverage for those same services if provided by a dentist or dental therapist.
The bill also requires the Department of Health Services to ensure that a Medical Assistance recipient who is pregnant has the opportunity to see a dentist or dental therapist within 30 days of being referred for dental services under the Medical Assistance program. A dental therapist is an individual who is licensed to engage in the limited practice of dentistry. The Medical Assistance program is a joint state and federal program that provides health services to individuals who have limited financial resources.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

(bo) The department shall ensure that any Medical Assistance

recipient that is referred by a health care provider for dental services under par. (b)

1. has the opportunity to be seen by the referred dentist or dental therapist no later

than 30 days after the date of referral if the recipient is pregnant on the date of the
12
referral or the recipient becomes pregnant prior to an appointment with the
13
referred dentist or dental therapist.
